Please provide a copy of the lease agreement between City of York Council (landowner) and Spark:York (tenant) on the shipping container site in Piccadilly, York.

In particular include all penalty clauses and all clauses whereby the tenancy agreement may be terminated by the Council in the event of the tenants failing to act properly; and specifically in the event of the tenants breaching the agreed details of their planning permission.

I am aware that the leaseholders have another company known as Spark:Bars. I understand this company is to have substantial income from the bars in the Piccadilly container complex.

Please clarify that profits made by Sparks:Bars will be included in the calculations for any profit share paid to the landlords - City of York Council.

I would like to advise that a request under the Freedom of Information (FOIA) Act is for information the council holds in a recorded form and is therefore usually a request for copies of documents or emails or extracts of information contained in them.

As your enquiry is a question asking for a yes or no answer rather than a request for copies of information, it is not a request under FoI. I will therefore send your request to the relevant manager for them to consider whether this is a question they are able to respond to.
