I write further to your request for information regarding lead replacement
pipes in the Ladybarn/Fallowfield Manchester M14 area.

 

Unfortunately it has not been possible to locate this information within
the statutory timescale, nor make a decision as to whether to refuse your
request.

 

I therefore write to advise that we are extending the time for our
response, pursuant to the Environmental Information Regulations 2004
Regulation 7 to 9^th January 2017.

 

Whilst we shall endeavour to respond to you sooner, we require the extra
time to try and locate the information, if held.

Re: Your request for information re lead pipe replacement scheme

 

We refer to your request for information regarding the above (as per your
e-mail of the 8^th November 2016 below).

 

We have been endeavouring to try and locate this information.
Unfortunately due to the nature of the way this information is reported/
collated, we have been unable to locate any information.

 

Under the Environmental Information Regulations 2004 (EIR) 12(4)(a), we
therefore regret to advise that we do not hold the information.

 

However, and again due to the nature of the way this information is
reported/ collated, even if it did exist it, would be manifestly
unreasonable to locate, retrieve and collate the information. This falls
under EIR Regulation 12(4)(b) as an exception to our obligation to provide
you with the information.

 

In deciding whether we are unable to provide the information by virtue of
it being manifestly unreasonable to obtain , we are also obliged to
consider whether it is more in the public’s interest to apply the
Regulation 12(4)(b) exception, or whether it is more in their interest to
withhold the information. In this instance, United Utilities is a large
scale water utilities provider serving in excess of 7 million customers.
Accordingly we are satisfied that it is more in the public’s interest to
apply our resources into providing a more effective water and sewerage
service to the public, than to divert those resources to try and meet a
request, where it has been burdensome to try and locate this information.

 

We would advise that even if we had been able to easily locate this
information, details as to whether specific property addresses could lead
to personally identifiable information and in particular whether they had
had lead pipe replacements. To release this would contravene the Data
Protection Act 1998. Thus under EIR Regulation 13, we would withhold this
information in any event.

 

We appreciate that this response is a source of disappointment to you, and
we must apologise for the technical nature of our response. However this
is in order to ensure we comply with our obligations under EIR.

 

Should you consider that that we have not adequately complied with our
obligations under EIR, you have the right to ask us to carry out an
internal review, by writing to David Hannon Head of Legal, United
Utilities, Legal Department, Grasmere House First Floor, Lingley Mere
Business Park, Lingley Green Avenue, Great Sankey, Warrington, WA5 3LP.
Alternatively, you may find it easier to e-mail us directly on
[1][United Utilities request email] and your review request will be forwarded on to
Mr Hannon.

 

Your request for review should explain why you wish a review to be carried
out, and should be made within 40 working days of receipt of this letter,
and we will reply within 40 working days of receipt. If you are not
satisfied with the result of the review, you then have the right to make a
formal complaint to the Information Commissioner.
