Initially I would like to clarify that The Freedom of Information Act gives you a legal right of access to any recorded information held by a public authority. We do not have to provide opinions or explanations, generate answers to questions, or create or obtain information we do not hold. I would like to explain that members of the public need to be aware that they do not have an unfettered right to access DWP offices and do so under what is referred to as an implied licence (an agreement giving permission for a
person to do something). This licence can be revoked if members of the public do not abide by the rules set by the DWP to protect its employees and the personal data of other members of the public. It is also important to bear in mind that the rules also exist to ensure the smooth running of the DWP and
activities which undermine this need to be curbed where possible. An example of this could be that headgear, such as hats, hoodies or crash helmets, be requested to be removed by claimants whilst on site where staff reasonably feel that this negates their ability to conduct the business for which
the customer is attending If you have any queries about this letter please contact me quoting the
reference number above.

First of all I am not seeking opinion or explanation, I am seeking factual authority in the form of recorded information regarding unfair impositions placed on the public you are duty bound to serve as civil servants.

You mention an implied licence. If this is what you rely on as your authority to impose such a practice, I require a copy.

This is not to be regarded as a new request, but a clarification of your as yet, incomplete response.

Dear Operations FOI Requests, in response to your refusal to either provide the information requested or conduct a proper review,I have no option but to refer you to the appropriate regulatory bodies for your wilful dishonesty in this matter, in not addressing the original requirement;

"under what jurisdiction or code under common law, do the agents of the Department for Work and Pensions in the guise of the corporate entity known as Job Centre Plus and any contracted security, determine what manner of dress determines entry qualification into a public building in order to discharge a government required function."

You have failed to provide evidence of jurisdiction and failed to provide any article of common law in this matter. Furthermore, you have not addressed these points in your review, merely repeated unenforceable prejudices of which the public have little or no awareness.

Dear Operations FOI Requests, in your latest response you state:
The FOIA does not oblige a public authority to create new information to answer questions; nor does it require a public authority to give advice, opinion or explanation in relation to issues/policies under question.

First of all I did not request the creation of anything, I merely asked for documentary evidence that such an implied licence exists. It is quite clear from your negative response that no such evidence exists., therefore no implied licence exists.

Secondly, I have not sought advice of any sort from you as this would be futile, bearing in mind the way you handle requests.

Your response is rejected based on your false and dishonest assertions and I await a truthful answer to my request without further delay.
