Dear Knowsley Metropolitan Borough Council,

Your recent 'escalation' policy states "“filming or recording of other persons without their consent is prohibited.”

1) Can you tell me under what law or legislation is the filming or recording of persons without their consent prohibited?

2) To adhere to your own "escalation" policy - How does Knowsley Council obtain the consent of members of the public in Council buildings when filming them on the Council's CCTV cameras?

Thank you for your email received on 25 September 2017 requesting information about consent to film.

I have recorded your request for information under reference F2017.09.3936.

This has been passed to the relevant service and you will receive a response by 23 October 2017.

In line with guidance published by the Information Commissioner’s Office, the council may make a charge for the provision of information – for example in order to cover the costs of postage (in line with the relevant postal charges) or charges for printing and copying (which will reflect photocopying charges levied by the council’s public libraries) or if this falls within the regulations of an EIR (Environmental Information).

You will be informed if a fee is to be applied before information is to be provided.

Freedom of Information request F2017-09-3936

We have looked into your request for information about Law or legislation
that requires consent to film, and our response is shown below.

Q1.     Can you tell me under what law or legislation is the filming or
recording of persons without their consent prohibited?

A2.     Filming or recording of persons without their consent can be a
breach of that person’s basic human rights under the terms of the    Human
Rights Act 1998. 

          In order to protect individuals who attend the Council’s
meetings but who may not wish to be filmed or recorded it is a condition
of     entry to the Council’s buildings that filming and/or recording is
restricted to that permitted by law and in accordance with the         
Council’s conditions of entry to its buildings. 

          Council staff can find filming and/or recording while carrying
out their work to be at best distracting and occasionally intimidating.
 In          order to protect those staff a decision was taken by the
Council that all filming and/or recording is prohibited within the
Council’s      buildings unless permitted under the legislation governing
meetings.  In terms of filming and recording outside of Council buildings
          you may wish to take your own legal advice as to what might be
permitted and any legal risks associated with doing so.

Q2.     To adhere to your own "escalation" policy - How does Knowsley
Council obtain the consent of members of the public in Council         
buildings when filming them on the Council's CCTV cameras?

A2.     This is from the conditions of entry to any Council building. 
Prominent notices are placed at various points in the building to inform
individuals that they may be filmed or recorded in the building and at
meetings.  On the basis that they continue to attend an        
individual’s consent is implied from their attendance so that consequences
will follow from a failure to comply with that condition.

Q1/A2

"can be " is NOT law. No one has ever attempted or succeeded in suing someone for breaching their human rights by filming them without consent. This is a ridiculous response. Especially when kMBC film people without their consent.

I would say that is a breach of someone's human rights and highly hypocritical, to make it a condition that they are filmed when they enter Council buildings, and yet you give your own staff a right not to filmed.

What planet are you on, that is dictatorial, oppressive, and most certainly a breach of human rights according to your own views (answer A2)

You are a gang of hypocritical bullies, this is a fact according to your own response to this FOI. It is not acceptable. I request an internal review of this hypocrisy.
