Laurencekirk Primary School - Head Teacher

The request was refused by Aberdeenshire Council.

Dear Aberdeenshire Council,

I would like to know the specific reasons for the current disposition of the Laurencekirk Primary School Head Teacher Mr G Boyd, who is still the designated Head Teacher at the school, but has been "seconded" to Carronhill School in Stonehaven for the past 6 weeks.

Why has Mr. Boyd been "seconded" to Carronhill School?
Is Mr. Boyd undertaken any specific training at Carronhill School
Is Mr.Boyd under investigation for an incident at Laurencekirk Primary School? If so, please provide information on this incident(s)
Who is currently the stand in Head Teacher at Laurencekirk Primary School?
Who is the Child Protection Officer at Laurencekirk Primary School whilst Mr.Boyd has been seconded? If the Depute Child Protection Officer has taken his role, who then is standing in as the Depute?
Will Mr. Boyd be returning to Laurencekirk Primary School and if so, in what capacity?

Notice of Refusal

 

We refer to your request dated 18/06/2018 08:45, for the following
information regarding Laurencekirk Primary School. 

 

We confirm that the Council holds the information that you have requested.

 

We have considered your request, but are of the opinion that the exemption
under the following section of the Act applies to the information
requested:-

Section 38(1)(b) – personal data where the "first condition" is satisfied

 

The information falls within the definition of "data" in the Data
Protection Act 1998, and the disclosure of the information to a member of
the public otherwise than under this Act would contravene-

(i)            any of the data protection principles; or

(ii)           section 10 of the Data Protection Act (right to prevent
processing likely to cause damage or distress).

 

We are of the opinion that this exemption applies because the information
you request constitutes personal data (as defined in the Data Protection
Act) relating to third parties. 

 

The First Data Protection Principle states:-

Personal data shall be processed fairly and lawfully and, in particular,
shall not be processed unless -

(a)       at least one of the conditions in Schedule 2 is met, and

(b)       in the case of sensitive personal data, at least one of the
conditions in Schedule 3 is also met.

 

The Schedule 2 conditions are not met.  Condition 6(1) has particular
application:-

 

The processing is necessary for the purposes of legitimate interests
pursued by the data controller or by the third party or parties to whom
the data are disclosed, except where the processing is unwarranted in any
particular case by reason of prejudice to the rights and freedoms or
legitimate interests of the data subject.

 

The circumstances of your request do not demonstrate that you have any
such legitimate interest in having these personal data disclosed to you.

 

Consequently disclosure would contravene the First Data Protection
Principle as being neither fair nor lawful.

This exemption is an absolute exemption and therefore we are not obliged
under the terms of the Act to provide you with the information requested.

 

If you are dissatisfied with the way in which we have dealt with your
request, you may require Aberdeenshire Council to review this decision.
