Latest MPA Report
Dear High Speed Two (HS2) Limited,
I would like to know the latest traffic-light rating given to the HS2 project by the Major Projects Authority. I would also like a copy of this report, or at least to know the areas of concern and/or suggested actions which have been recommended.
I make this request under both the FOIA and the EIRs. I feel the need to point this out, as despite rulings from the Information Commissioner on cases FER0467548 and FER0536325 submitted by Dr Paul Thornton, which established that MPA reports on HS2 contain environmental information as defined in the EIRs, with my most recent request FOI14-1231R to you regarding a previous MPA report (which has now been ruled on by the ICO as FER0570401, as has the associated FER0578594 to the Cabinet Office) you failed to accept any obligation to comply with my request under the EIRs.
I sincerely hope you will accept the consistent rulings of the ICO, that MPA reports on HS2 are covered by the EIRs and reply accordingly, instead of employing the continual obfuscation I have come to expect when making these requests. I also do not expect a message claiming you do not 'own' the information as happened last time, as there is no concept of information “ownership” under the FOIA or the EIRs. Clearly HS2 Ltd hold the information requested.

I note your response of 18th September to this request. Please consider this as a request for an internal review. I wish to appeal to your decision and wish to make supplementary requests based on your response, which are outlined below.
Given that all the previous reports from the MPA have been provided to HS2 Ltd, and the fact that it would seem completely pointless for the MPA to produce reports on HS2 and then not provide them to HS2 Ltd, this raises a concern that there has been a possible breach of EIR regulation 19, if the requested information in respect of this most recent MPA assessment was provided to any employee or other representative of HS2 Ltd at any time and in any format.
If so, when was the latest MPA report and/or recommendations for action received by HS2 Ltd?
If the information above has been deleted or destroyed when did this occur?
If so, why was it destroyed or deleted?
Have email and phone text records of senior HS2 officials been checked for this information?
Is there any record of HS2 staff being given an explanation of why MPA project reports would no longer be provided to them?
What meetings have HS2 Ltd staff members attended to discuss the most recent MPA project report, which HS2 Ltd staff members attended them, and can you please provide the minutes of any such meetings?
I remind you that my original request was not simply to ask for the MPA report, as I expected obfuscation on this point, but to also request the traffic-light rating and areas of concern and/or suggested actions which have been recommended.
As such, are you saying that there is no official record of the latest traffic-light rating held within the organisation? Additionally, are you saying that there is no record of areas of concern and/or suggested actions which have been recommended by the MPA? Whilst HS2 Ltd does not seem to have a great record in terms of implementing recommendations from the MPA, I would expect this would be completely impossible if no-one within the organisation knows what the recommended action points are, as you have suggested.
