Language Services Framework Agreement

1. Can the MOJ provide details of which the “other parties” are that are referred to as part of the Language Services Framework Agreement, other than Capita, that they will be working with to improve the agreement and the services being delivered?
2. Reference is made in the Parliamentary evidence and also the National Audit Office report of the Agreement being for 5 years, when was this change in term agreed and under what basis was the 3 year term extended to 5 years.
3. During the Parliamentary evidence it was stated that there was a “new approach to assessment” of linguists, what is this new approach and why was the change made if Capita Translation/ALS signed the agreement based on the original assessment of linguists?
4. Has the MOJ increased the amount it pays Capita Translation/ALS under the Framework Agreement?
a. From the values submitted by ALS during the bidding process
b. Since the contract went live February 2012
5. Have there been any other substantial changes in the requirements under the agreement:
a. From those agreed by ALS during the bidding process
b. Since the contract went live February 2012

Freedom of Information Request

Dear Interpretation Project (FAO Leslie Muir),

I was disappointed with your incomplete response dated 4 December 2012 and I respond accordingly.

Given your acknowledgement of my request of the 9 November 2012 on 12 November 2012, why did it take you until 4 working days prior to the end of the period for your response to communicate that you required further information, surely the time to bring that to my attention would have been at the point you acknowledged my request. Filibustering of this nature does not show either you or the Ministry of Justice in a positive light.

For the record I expect my request to be responded to on a point by point basis clearly detailing all facts. I would also draw your attention to the guidance you directed me to

“This means more than simply telling them that their request is not specific enough, the public authority should take reasonable steps to provide assistance to the requester.”

In an effort to ensure you do not delay your response further and to enable you to respond within the original timeframe I have provided the following publicly available information relating to the Parliamentary Public Accounts Select Committee and National Audit Office report:

1. The “other parties” are referred to in the final bullet point on page 6 of the National Audit Office report “The Ministry of Justice’s Language Services report” dated 10 September 2012.

2. The Parliamentary Evidence is from Public Accounts Select Committee evidence on the ALS/Capita/Ministry of Justice hearing on 19/11/2012. The National Audit Office report reference is as per the report in 1 above contained within the opening paragraph on page 4 of the report.

3. The Parliamentary Evidence referred to is from the Public Accounts Select Committee evidence on ALS/Capita/Ministry of Justice hearing on 29/10/2012, response to questions 338-340.

4. Given the lack of structure around your response can you clarify your response to both points a and b, prior to responding you may wish to review the Parliamentary evidence and the National Audit Office report.

I am writing to request an internal review of Ministry of Justice's handling of my FOI request 'Language Services Framework Agreement'.

The reason for this review:

* is the poor quality response received for my original request, for example the lack of structure in responding to the questions

* in response to my original request the MOJ ignored my first question offering no response

* the request for clarification was not carried out in a timely manner, see my response to the MOJ for full details,specifically why was clarification not requested in the acknow;edgement of my original request

* the clarification of the original request is being treated as a new request under timescales for a new request, this is not appropriate as it is not a new request, it is clarification and should be dealt with within the original timescales
