Dear Powys County Council,

This is a request for information under the Freedom of Information Act 2000.

I would like to request the following information:

For the financial years 2018/2019, 2019/2020 and 2020/2021, please provide:

– The number of landlords prosecuted by the council
– The number of complaints the council received about private rented properties
– The number of civil penalty notices issued against a landlord or letting agent as well as the total annual sum of the fines.

I would like to receive the information in an electronic format. If you feel that a substantive response to this request is not possible within a reasonable time frame, or the request is too broad, I would be grateful if you could contact me and provide assistance as to how I could refine the request.

Dear Mr Bychawski

 

Thank you for your request for information, received at this office on
21/09/21, in which you requested details of the following:

 

Landlord Prosecutions

 

The above is a summary of your request. The full details of the
information sought is provided to the officer to whom the request is
tasked.

 

Your request will now be considered and you will receive a response within
the statutory timescale of 20 working days as defined by the Act, subject
to the information not being exempt or containing a reference to a third
party. In some circumstances Powys County Council may be unable to achieve
this deadline. If this is likely you will be informed and given a revised
time-scale at the earliest opportunity.  In this instance, please note
that there may be a delay in providing you with a response because as of
23rd August 2021, the Council’s re-invoked it’s Business Continuity Plans
in response to increasing Coronavirus pressures.

Invoking the business continuity plan allows Powys County Council to
concentrate resources on priority activities. Staff, including all
Information Compliance Officers have been redeployed to assist Social
Services and Test, Trace & Protect. It has therefore been determined that
requests made under Freedom of Information Act 2000, the Environmental
Information Regulations 2004 and General Data Protection Regulations will
be acknowledged but possibly not dealt with until business resumes as
normal.  If we are able to respond earlier then we will of course do so.

 

There may be a fee payable for the retrieval, collation and provision of
the information you request. If this is the case you will be informed and
the 20 working day timescale will be suspended until we receive payment
from you. If you choose not to make a payment then your request will
remain unanswered.

 

Some requests may also require either full or partial transference to
another public authority in order to answer your query in the fullest
possible way. Again, you will be informed if this is the case.

 

The anticipated due date for responding to this request for information is
19/10/21.

Dear Mr Bychawski

 

Further to your request for information held by Powys County Council, the
service area dealing with your request require some clarification.  In
regards to question 1, “The number of landlords prosecuted by the
council”, please could you clarify whether you are seeking the overall
number of prosecutions which are in relation to specific offences?  If
this is the case, please could you specify which offences these are? e.g.
offences under the Renting Homes (Fees etc.) (Wales) Act 2019 etc.
