Our Members are concerned regarding the future of the above area of land and will remain so unless the imported fill material is removed and the land is restored to its original condition prior to the unauthorised airport parking operation against which your authority took enforcement action.

Until such time with the hard-standings in place the land remains vulnerable to further unauthorised uses or pressure for development.

In order for our Members to fully understand the current position please provide copies of all emails, letters, meeting/telephone notes, memoranda and any other documents whatsoever that relate to this land since 1st January 2013 between your authority and the landowner or any other authority or agency.

Thank you for your request for information. We are replying to you under the Environmental Information Regulations (EIR) as the request relates to matters concerning the environment. Please find enclosed copies of correspondence/documents as requested. The Enforcement and Stop Notices are public documents.

Please note: We have not included the tenancy agreement as described in the Ms Heal letter, as this is a private agreement between Ms Heal and Air Parking Limited.

Under the EIR the council is entitled to apply an exception if it believes one exists. In this particular case we believe the following exceptions apply:

Section 12 (5) (b) - the course of justice. We hold information relating to legal proceedings regarding this land which we will not be releasing. This exemption is subject to the public interest test. In this case we believe that the disclosure of court proceedings would have an adverse effect on future similar proceedings and therefore it is not in the public interest for these documents to be released.

Section 12 (5) (e) - the confidentiality of commercial or industrial information where such confidentiality is provided by law to protect a legitimate economic interest. This exemption is subject to the public interest test. In this case we believe that the papers relating to an ongoing legal matter are commercially sensitive and their disclosure would harm the commercial position of the council and third parties.

We note your authority wrote to the landowner on 18th May 2015 as part of the Call for Sites for Traveller pitches within the District requesting a response by 2nd June 2015 as to whether the site could potentially be available for this purpose.

Please confirm whether a response was received from the landowner either before or after 2nd June 2015.

We further note that a press release from Dianne Talbot on 14th October 2015 was not included in the response to our request and are therefore concerned your response may not be complete or information which should properly be released has been incorrectly withheld under Section 12 (5) (b) and Section 12 (5) (e) of the EIR.

Please ensure all information which should properly be released in response to our FOI request has been provided.

We can confirm that no reply from the landowner was received to the letter sent out.

Our press releases are all published on our website, please see http://www.midsussex.gov.uk/my-council/c... and we would not include these in a response as the information is publically available. However, we cannot find a press release dated October 14th 2015 on the website, nor any other close to that date that refers to a traveller site. Are you referring to some other form of communication by Diane Talbot? Can you please clarify.
