Dear Southern Water,

Could you please provide me with:

1) a GIS compatible file (GeoJson/Shapefile or .KML/.KMZ) of your land boundaries/land that you own or manage.

2) If also held, a GIS compatible file (GeoJson/Shapefile or .KML/.KMZ) of roads/access tracks on land that you own or manage.

I would like to request this information under Environmental Information regulations, and ln light of the upper tribunal decision in GIA/0979/2011 that water companies are a public authority for the purposes of EIR

For the sake of clarity and simplicity, my primary interest is in expanses of land owned, eg. catchment areas, moorland, forestry, agricultural land, reservoirs and access roads - as such I am happy if you wish to redact buildings or covered reservoirs in urban areas or which you may wish to redact for security reasons

Thank you for your request for information which we received on 21 May
2019 and which reads as follows:

 

Could you please provide me with:
1) a GIS compatible file (GeoJson/Shapefile or .KML/.KMZ) of your land
boundaries/land that you own or manage.

2) If also held, a GIS compatible file (GeoJson/Shapefile or .KML/.KMZ) of
roads/access tracks on land that you own or manage.

I would like to request this information under Environmental Information
regulations, and ln light of the upper tribunal decision in GIA/0979/2011
that water companies are a public authority for the purposes of EIR

For the sake of clarity and simplicity, my primary interest is in expanses
of land owned, eg. catchment areas, moorland, forestry, agricultural land,
reservoirs and access roads - as such I am happy if you wish to redact
buildings or covered reservoirs in urban areas or which you may wish to
redact for security reasons

We are dealing with your request under the Environmental Information
Regulations 2004. As required by the legislation, we normally aim to
answer your request within 20 working days from the date we received it.
This period can be extended to forty days if the complexity and volume of
information requested means it is impractical either to comply with the
request within the earlier period or to make a decision to refuse to do
so. In this case we consider that the complexity and volume of information
you have requested will require more than twenty working days to provide
you with the information.

 

We want to be as open as possible in answering requests, and to help
people obtain the information they are looking for. Unfortunately, in this
case the amount of information you have requested is substantial.
Gathering it together would therefore be likely to involve a significant
cost and diversion of resources from Southern Water's other work. This
could mean that we might have to charge you for the work involved, or even
have to refuse the request (under the exceptions in the Environmental
Information Regulations 2004 covering requests that are manifestly

You asked me to refine my request

As stated in my original request, I am looking specifically for information on expanses
of land owned, eg. catchment areas, moorland, forestry, agricultural land,
reservoirs and access roads.

Given that your organisations network data is stored in a GIS system (and from previous vacancies displayed online you employ GIS professionals) I believe that an extraction of this data should be a fairly simple task, since properly/land boundaries are clearly established operational data that would be used on a regular basis.

Thank you for your request for information which we received on 21 May
2019. We have dealt with your request under the Environmental Information
Regulations 2004. This letter provides the response to your request, which
reads as follows:

2) If also held, a GIS compatible file (GeoJson/Shapefile or .KML/.KMZ) of
roads/access tracks on land that you own or manage.

We have reviewed your request under the Environmental Information
Regulations 2004 and have taken the decision not to disclose the
information requested due to the information falling under the exception
set out at Regulation 12 (5)(a) “a public authority may refuse to disclose
information to the extent that its disclosure would adversely
affect international relations, defence, national security or public
safety.”

 

Further the extent of work required to redact the information that poses a
security risk would be considerable and so engages the exception set out
at Regulation 12 (4)(b) “a public authority may refuse to disclose
information to the extent that – the request for information is manifestly
unreasonable.

 

We are entitled to make a reasonable charge for information provided
under the Regulations. Details of our charging scheme can be found on our

In this case we have decided to waive our charge.

 

If you are dissatisfied with the handling of your request, you have the
right to ask for an internal review. Internal review requests should be
submitted within forty working days of the date of receipt of this

Services Ltd, Southern House, Yeoman Road, Worthing, West Sussex BN13 3NX.

 

If you are dissatisfied with the outcome of the internal review, you can
apply, without charge, to the

Information Commissioner, who will consider whether Southern Water has
complied with its obligations under the Regulations, and can require
Southern Water to remedy any problems. You can find out more about how to
do this, and about the Regulations in general, on the Information
