Land management plans Aldershot training area

Dear Defence Infrastructure Organisation,

I am writing to request copies of the following internal mod documents

i) current and/or former editions of the 'integrated land management plan' or 'integrated rural management plan' for the Aldershot, Hankley, Ash, pirbright and Longmoor military training areas in ATE Home Counties

ii) reference is made in a 2003 MOD commissioned report that:

"EN and DE have produced ‘Guidelines for Assessment of Recreational Events by Defence Estates’ for all of the MOD sites within the Thames Basin Heaths pSPA and Thursley Ash, Pirbright and Chobham cSAC. This guidance outlines the possible impacts of recreational events/recreation and best practice to minimise the impact."

I wish to request a copy of these guidelines, both former and current.

Dear Defence Infrastructure Organisation,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of Defence Infrastructure Organisation's handling of my FOI request 'Land management plans Aldershot training area'. FOI ref 02390

Part of the requested information was refused in the basis of a section 22 exclusion, "information intended for future publication"

My first ground for review would be that no indication has been given for the timescale of publication - given I had to resort to FOI for publication of the OLD version of this document, it seems inconsistent that the new version is going to be published and available in the near future.

Further the response provided stated that:
"The outcome of the public interest test clarifies that the public interest in withholding the information outweighs the public interest in disclosing the information, as it is important for the public authority to place information in the public domain proactively and to avoid damaging the reputation of the government bodies."

I find it a strange argument that the best way to place information in the public domain "proactively" is to withhold its publication until an unknown date in the future when the Policy is no longer in force

Further to this I would put forward that upholding the reputation of government bodies by withholding otherwise valid information is an invalid, possibly illegal use of the public interest test (otherwise any government department could suppress embarrassing information.

My final request for review would be the handling of my application as FOI rather than EIR - given the information clearly refers to rural land management plans, I would suggest that it constitutes environmental information.

Defence Infrastructure Organisation (DIO) on behalf of the Ministry of
Defence. The review will involve a full, independent reconsideration of
the handling of the case as well as the final decision.

Your request clearly falls within the definition of environmental
information specified in section 2(1)(a) of the Regulations which defines
environmental information on “the state of the elements of the
environment, such as … soil, land, landscape and natural sites including
wetlands, coastal and marine areas...and the interaction among these
elements” (our emboldening) and in 2(1)(c) of the Regulations covering any
“measures or activities designed to protect those elements”.

We offer our sincere apologies for the incorrect processing of your
information request and will correct this as part of the review.

The time limit for completing EIR internal reviews is 40 working days and
we therefore shall aim to complete the review and respond to you by 27
July 2015.
