Land information

We're waiting for Mark D to read recent responses and update the status.

Dear Staffordshire County Council,

I live in an area with a piece of land at the rear of the property. It is vacant land which gets rubbish dumped on and we are forever cleaning it up.

I would like to know who the land belongs to. We have two other councils that do not seem to know however insist it is not their land. Checkley parish council and Staffordshire moorlands

The land in question is in Lower Tean, Staffordshire, ST10 4LS

The reference number for the land registry is;

SF5157

Also are there any third party interests or does it belong to a single organisation/individual

Yours faithfully,

Mark D

Dear Mark Demaine

Thank you for your request for information.

On 11 June we asked you for details of your postal address/precise location of the land about which you are enquiring to enable the service to correctly identify the area of land that your request refers to and any records that we may hold. In your reply, you have declined to provide information to enable us to provide a fully accurate response. We can therefore only make assumptions about the location.

The serrvice have assumed that you are enquiring about the area of land adjacent to the north of Uttoxeter Road which is within the vicinity of the postcode you have provided. Should this not be the case, we are unable to provide more accurate information without a full postal address or other relevant means of location such as a grid reference.

Based on our assumptions, although we do not own the subsoil we can confirm that the grass verge does form part of the Highway Maintainable at Public Expense by this highway authority, the council do not own the land and do not hold information regarding third party ownership.

If the title of the land is registered, details of ownership should be available to you from the Land Registry - https://onlinelandregistry.org.uk/?utm_s...

If you have any comments relating to how your request has been handled by our authority you should contact us in the first instance.  Send your comment or complaint to:

Access Manager, Access Team, Staffordshire County Council, 2 Staffordshire Place, Stafford ST16 2DH or email [email address]

If you then have any further comments relating to how your request has been handled by our authority, please contact the Information Commissioner, Wycliffe House, Water Lane, Wilmslow, Cheshire SK9 5AF.

Dear Portch, David (Corporate),

Thank you for the response.

I have evidence to prove this incorrect, could I please get a copy of the evidence?

This has suddenly been conjured up over the last couple of weeks and I have evidence of that too.

The local council are acting like a local mob and they have been threatening workers at my neighbours house which was also related to this matter.

I look forward to investigating this further

Yours sincerely,

Mark D

Dear Mark

I am sorry that you are not satisfied with the response provided. I am afraid that I have no knowledge of the area or the matters to which you refer in your email.

The Access to Information Team are only responsible for processing access to information requests and do not have direct access to service records or systems. I will of course forward your email to the relevant service teams for them to review your request.

However, as you appear to be unwilling to provide details of the exact location of the land which is the subject of your request it is difficult to provide more accurate or detailed information. As per our previous emails, if you do not wish to give these details via a public website such as WhatDoTheyKnow then you can provide location details direct to us using the following email address - [email address]

If you have any comments relating to how your request for 'recorded information' has been handled by our authority you should contact us in the first instance.

Dear Mark

Further to my email below, 17 June, concerning the response to your request for information our Legal Services department have performed an enquiry at Land Registry against information on the attached email (title - SF5157).

I attach a map search of the site, see land shown green. The map seems to be a series of roads with 5175 appearing to relate to the green area adjacent to the A522, Uttoxeter Road.

If this is the land to which your enquiry relates, it would appear that if the area marked 5157 relates to the green area adjacent to the footpath and carriageway at this location then our highways service have already confirmed that although the council does not own the subsoil they can confirm that the grass verge forms part of the Highway Maintainable at Public Expense by this highway authority, the council do not own the land and do not hold information regarding third party ownership.

We have not downloaded title register or official plan - as there is a cost for each - at £3. If would like to know who the proprietor/owner is the Land Registry register is the most accurate and up to date method of obtaining this information.

As the information is readily available on the Land Registry's public register - (subject to £3 cost) and is therefore available to you by other means we are not obliged to obtain copies of documents held by the Land Registry on your behalf.

If you have any comments relating to how your request for recorded information has been handled by our authority you should contact us in the first instance.

As previously advised, should you wish to make a complaint about the actions, or inaction, of Staffordshire County Council or its staff details of how to do this are available on our website - https://www.staffordshire.gov.uk/Contact...
