It is understood that this land is owned by Denbighshire Council so please provide copies of:

1. The Council Minute which authorises the grant of a short term licence to SG Estates
Limited and the relevant authority given to the Proper Officer to negotiate the terms of that
licence including details and provision for reinstatement of the land to its previous use and
condition;

2. A copy of the Planning Certificate grant planning consent for this use together with the
relevant conditions imposed:

Thank you for your request for information received 04/06/2019 regarding 
VICARAGE ROAD, LLANGOLLEN. Please see below:

 

1. The Council Minute which authorises the grant of a short term licence
to SG Estates Limited and the relevant authority given to the Proper
Officer to negotiate the terms of that licence including details and
provision for reinstatement of the land to its previous use and condition;
The Developer (SG Estates) has been granted a licence to use part of the
paddock as a compound during their construction works.  The short term
licence was granted by the Valuation and Estates Manager who has delegated
powers to grant such an agreement.  There is a condition that the land
will be reinstated to grazing land at the end of the agreement.

 

2. A copy of the Planning Certificate grant planning consent for this use
together with the relevant conditions imposed:

Planning have been consulted. They advised that no planning permission is
required to utilise the land as a compound for the duration of the build
project.

Dear Kerry,

Section 57 as amended of the Town & Country Planning
Act, 1990 states:

“Planning Permission is required for the carrying out of any development of land”

Section 55 as amended defines development as:

“The carrying out of building, engineering, mining or
other operations in, on, over or under land or the making
of any material change in the use of any buildings or other
land”

This land was previously a pony paddock and it has been
stripped of considerable top soil, substantially hardcored
and surfaced. Three portacabins have been stationed on
the area and considerable building materials are being
stored thereon. Surely this is development and the
Planning Officer is also failing to take into account the Supplementary Planning Guidance in relation to the
UNESCO World Heritage Site and the impact of development
on neighbouring properties.

Could you supply a copy of the Minute which delegates
powers to your Valuation Officer to agree the terms of a
Licence to SG Estates LTD?
