I have pleasure in providing you with the following:

1. Who are the groups of people that are class has homeless but do
not fit into your policy for assistant from Lambeth Council?

Lambeth does not have a policy. All Local Authorities have a statutory
duty to assist certain individuals on becoming homeless as determined
under Part VII of 1996 Housing Act as follows:

o pregnant women
o persons with dependent children, or with who dependent children might
reasonably be expected to reside
o persons who are vulnerable - because of old age, mental or physical
disability, or other special reason
o persons who are homeless in emergency - like a fire, flood or other
disaster.

The following categories were added to this list by the Priority Needs
Order 2001:

o 16 to 17-year-olds (not `relevant children'/children in need under
[1]Children Act 1989 and [2]Children Leaving Care Act 2000
o young persons under 21 who are looked after/accommodated between 16
and 18
o young persons under the age of 21 who may be vulnerable* as result of
being looked after/accommodated/fostered

Also those who may be considered vulnerable*

o as a result of custodial sentence/remand to custody/contempt of
court/kindred offence
o as result of leaving accommodation because of threats of violence
o as result of being in HM forces

* ("vulnerable" as defined under R v London Borough of Lambeth ex p
Carroll 1987 /R v Camden LBC ex p Pereira 1998)

2. How long should it take for their details to be updating on the
Housing register has homeless- who would do this?
The details on an individuals' housing register application is updated
automatically only once a full housing duty has been accepted. The
applicant will then be added to the E List (Homelessness) and authorised
for bidding. If no duty is accepted then it will be up to the individual
to inform the Council of any changes in circumstances if they are
registered on the Housing list.

3. Once documentation of homeless is presented what happens to this
information?
The information is used to assist the Council with its' enquiries into a
persons homeless application and to determine what duty if any is owed to
an individual. All documentation is scanned and loaded onto our systems.

4. What scheme do you have to help homeless people whom you do not
deem has a priority?

The Council's duty towards homeless people who are not in
priority need is to provide appropriate advice and assistance. This
includes:

- Help and advice on joining the Housing Register and how to bid for
properties as part of the Choice Based Lettings Scheme.

- Information about private rented accommodation.

- Information about the Council's Homefinders Scheme which assists people
without a deposit to take up a private tenancy.

- Information about other organisations or services that may be able to
help

5. What is average time scale from when they have notify you of
their situation to the eviction should help (advice) be provided?

We do not set a specific time scale as our aim is to provide advice at the
earliest possible stage once someone contacts us for help. Normally we can
see people by appointment within three working days and offer initial
advice.

6. When do you class a person has homeless is it from
Procession notice or eviction notice?
Once a possession order or warrant has been granted by the Court the
person is deemed statutory homeless.

7. What advice should be given to the individual from the Housing
Option officer and allocation customer service officer?

The Housing Options Officer will advise on any steps which can
assist in preventing homelessness and on the possible options available
where homelessness has
occurred.

8. Where can information be found on Lambeth Website on the produces
and policy on homeless? (I have checked your website but the information
is limited and does not give any guidance on what should be provided when
a person has a homeless issue.

All statistical information related to housing performance is
electronically recorded for statutory returns.

10. And under what British (English) government ACT should you add
the person has homeless on the Housing register.

Allocations of housing for individuals are determined under Part VI of the
Housing Act 1996.

11. How long should this take for the allocation team to process
the information. Under what law can they refuse to process this
information?

We aim to update change of circumstances within 2 weeks (10
working days). There is no law as such in relation to refusing to process
information. We will take
account of any change of circumstances that has a material
affect on someone's housing application.

Thank you for your email dated 28/04/12, requesting an internal review of
the Council’s response to your Freedom of Information Act Request
reference 140233

 

The Council has now conducted a review and the original response is not
upheld for the following reasons:

 

It is with great regret that your request was not answered in full, this
was an administrative oversight and one that we apologise for
unreservedly.

 

Your additional question asked:

Thank you for your reply. Can you clarify what the allocation would be of

Our response is:

“Someone on the mainstream housing register who is statutory homeless but
does not have a priority need will be awarded 20 points in Group H due to
being homeless. The points system is set out on pp.12-13 of the Lambeth
Housing Allocations Scheme 2008, which is available at
[1]www.lambeth.gov.uk.”
