Lack of of information in passing a law that said no further changes can be made to Public Service Pension Schemes for 25 Years.

The request was refused by Cabinet Office.

Dear Cabinet Office,

I asked the following on 23 March 2013 and was told that you could not releases the information to me and was told on 24/29 April 2013 that the Cabinet Office does hold information pertaining to your request and consideration was being given as to whether s36 of the Freedom of Information Act would apply. The Cabinet Office have concluded that it does not.

You then stated
"However, the information you have requested is exempt under section 35(1)(a) and
(b) of the Act, which protects the formulation of policy and communications between
Ministers. Disclosure would weaken Ministers’ ability to discuss controversial and
sensitive topics free from premature public scrutiny."

As the discussions have now finished and you have past the Act can you please let me have copies of the information I requested.

What I said previously is below.

I can't understand how a Government can pass a law stating that no
further changes can be made to public service schemes for 25 years
even though they knew that they were introducing a flat rate state
pension where the employer was going to loose 3.4% NI rebate.
Because of this public service schemes can't pass on the increase
of NI or reduce the pension.

1)Were you not told by your advisers that this would happen.

2)How can you pass a law that favours public service schemes.

3)Who agreed in the Cabinet to sign off this change to a flat rate
pension and not allowing public service schemes to pass on extra
costs when loosing NI rebate especially when changing the law to
allow non public service schemes to pass on extra cost to employees
or reduce their pension.

Dear FOI Team Mailbox,

I am not very happy with your reply telling me that you can only send me recorded information that already exists and does not require you creating new information to respond to the request. You seem to be indication that in order to deal with my request you need to create new information.

If you look at previous correspondence where you replied to me on 24 April 2013 FOI1317700 you will see that your office told me that the Cabinet Office held information relevant to my request, so would not have thought that this now involved creating any new information.

Can you please tell me why you now think you have to create new information when I have been told the Cabinet Office hold the information I requested.
