Arthur, the Council released the Klonowski report in January of this year....albeit redacted.

Here is a link to an article, setting out what I feel is the background and true motivation behind Wirral Council's very poor response times.

Notably, there are just 2 people dedicated to Freedom of Information and Data at this council (one professional and one admin assistant) - which says it all really.

I refer to your request for information dated 17 July 2012, which was
as follows:-

On 24 August 2012, you asked for an internal review in respect of your
request for information. On 18 January 2013, the Council responded by
providing an electronic link to the redacted report by Anna Klonowski,
dated 9 January 2012. On 21 January 2013 you requested an unredacted
copy of the report by Anna Klonowski. I am responding to your request
for an internal review and apologise for the delay.

I confirm that the information requested is held but I consider that the
information you have requested is exempt information under Section 41 of
the Freedom of Information Act 2000, in that it was obtained by the
Council as a public authority from any other person, and the disclosure
of the information to the public by the Council would constitute a
breach of confidence. (Section 41 (1) (a) and (b) of the Freedom of
Information Act 2000.)

I have had regard to the Awareness Guidance 2-information provided in
confidence, version 4 issued by the ICO on 12 September 2008. I have had
regard to the nature of the information which has been obtained by the
Council from any other person, namely the full report from Anna
Klonowski. I consider that if information were disclosed in response to
your request that any breach of confidence would be actionable by the
person to whom the duty of confidence was owed including third parties,
i.e. individuals and service providers named in the full unredacted
report who have not been identified in the Key to the report referred to
below.

I am satisfied that the information has the necessary "quality of
confidence" referred to in Awareness Guidance No 2 and that an
obligation of confidence exists. I have therefore concluded that the
Council owes a duty of confidence and that the exemption contained in
Section 41 applies to your request. Although this is an absolute
exemption under the Freedom of Information Act 2000, I also consider
that the wider public interest in maintaining this confidentiality
outweighs the public interest in disclosure. I have had regard to the
interests of the persons and organisations to whom the duty of
confidence is owed. The question is whether disclosure to the public
would be a breach of confidence. I consider that there would be such a
breach of confidence if a full unredacted copy of the report information
were disclosed to the public. The duty of confidence in this case is
owed to Anna Klonowski, individuals and service providers not identified
in the Key provided below.

I also consider that your request for a full unredacted copy of the
report of Anna Klonowski is exempt information under section 40(2) of
the Freedom of Information Act 2000, in that you are asking for
information which includes information about individuals, i.e. personal
data, in respect of which you are not the data subject.

I consider that the disclosure of the requested information would
contravene the first data protection principle, that personal data shall
be processed fairly and lawfully, and shall not be processed unless at
least one of the conditions in Schedule 2 of the Data Protection Act
1998 is met.

I do not consider that any of the conditions in Schedule 2 would be met
and particularly Condition 6 of Schedule 2 in that the processing would
be unwarranted by reason of prejudice to the rights and freedoms or
legitimate interests of the individuals identified in the full
unredacted report. I do not consider that such processing would be
necessary for the purposes of legitimate interests pursued by yourself
as a third party. The individuals who have not been identified in the
redacted report, and who were not identified in the Key to the report,
(see below) would have a reasonable expectation that their personal data
will not be disclosed to third parties. I consider that the processing
of any personal data related to the individuals named in the report
whose identity has not been disclosed in the Key would be unwarranted.


I enclose a copy of the Key to the report, which contains details of
some individuals and service providers, which Council agreed could be
placed in the public domain on 20 February 2012. I also enclose a copy
of the redacted report, considered by Council on 12 January 2012.

I am therefore refusing your request for information, relying on the
exemptions contained in Section 40(2) and (3) (a) (i) , and Section 41
of the Freedom of Information Act 2000.These are absolute exemptions and
not subject to the public interest test.

If you are dissatisfied with the response you also have the right to

I am writing to request an internal review of Wirral Metropolitan Borough Council's handling of my FOI request 'Klonowski Report'.

I feel that your response is unjustifible, and that the general public have a right to see the full report that was paid for by Wirral residents.

I understand there may be exemptions that you rely on to hide information that the public would find appalling, but the fact that you have spent £250,000.00 out of the public purse for a damming report into the DASS debarcle and are unwilling to share it in it's entirity, shows how open and transparent WBC is, whilst carrying on trying to distroy MR Morton (the whistle blower).
Please review your response.

I have spent the last two days reading the AKA report & whilst being proud of what Martin Morton tried to do he was like a voice in the wilderness fighting a lost cause A, against the inept management who have no grasp on the underlying miss management & B, the corrupt providers who fleeced not only the victims but wirral ratepayers as well.
The council & its officers do not know the meaning of the words "Corporate governance" & are so lacking in management skills they are not fit for purpose, I suggest people take the time to read the aka report as it cost nearly a £1000.00 a page & see what she thought in points

which are extolling what Martin was trying to expose & the shortcomings of its officers & Directors the councilhas a lot to answer for.
If you get time go to wirral leaks & look up Klowinski for dummies to see what the councilor responsible answer to the allegations as usual the old wirral adage
NO CASE TO ANSWER, I don't think so but read it for yourself & draw your own conclusions.

As it may interest the FOI requester, I've recently published the appendices to the Anna Klonowski Associates report here http://johnbrace.com/2013/11/23/anna-klo... (which comprise 401 pages).

Sadly all names (including from pages in it that are published online unredacted) have been removed, but hopefully it'll help you better understand the main report.
