This request is made after advise from the Valuation Office Agency who state that Kirklees Council would be the source of this data, and the Valuation Tribunal.

I am writing in response to your request dated 14 March 2019. This has
been dealt with under the Freedom of Information Act 2000.
You asked for the following information:
Please provide under the FOIA, the Kirklees Borough Council's Council Tax
Valuation List as first published April 1993 for the postcodes WF16 0BQ
and WF16 0BH.
This request is made after advise from the Valuation Office Agency who
state that Kirklees Council would be the source of this data, and the
Valuation Tribunal.
The Council’s response is set out below:
The Council does hold the requested information but considers this is
exempt under Section 21 of the Freedom of Information Act, because the
information is reasonably accessible to you by other means, because it is
already in the public domain.
Section 21 of the Act provides that:
(1) Information which is reasonably accessible to the applicant otherwise
than under section 1 is exempt information.
(2) For the purposes of subsection (1)—
(a) information may be reasonably accessible to the applicant even though
it is accessible only on payment, and
(b) information is to be taken to be reasonably accessible to the
applicant if it is information which the public authority or any other
person is obliged by or under any enactment to communicate (otherwise than
by making the information available for inspection) to members of the
public on request, whether free of charge or on payment.
(3) For the purposes of subsection (1), information which is held by a
public authority and does not fall within subsection (2)(b) is not to be
regarded as reasonably accessible to the applicant merely because the
information is available from the public authority itself on request,
unless the information is made available in accordance with the
authority’s publication scheme and any payment required is specified in,
or determined in accordance with, the scheme.
The VOA is the keeper of the list and the information requested is
available on the Gov.uk websites for all postcodes, and therefore
addresses, here: [1]https://www.gov.uk/council-tax-bands along with
information as to when a change is made.
If you are not content with the handling of your request, you have the

Dear Freedom Info,
Thank you for your response, the information requested is not in the public domain as property prices paid pre 1995 are not available.
The Land Registry also confirm this through an FOIA request made on this site by another individual.
The information contained on the VOA site does not show the value of a property made in April 1991 and simply shows the current band of a particular postcode / street, therefore it is impossible to find the appraised value of any home listed.
Given that Council Tax is based on the valuation (or alleged valuation) of property in April 1991 and in full knowledge that properties in the Postcodes mentioned were half of that which would place them in Band B, it is apparent that for 26 years every property in WF16 0BH has paid far in excess of that which it should have by way of Council Tax, and therefore have suffered financial losses due to misrepresentation or misleading data being used.
With that in mind I would again request the information specified (the Valuation List used by the Council April 1993) in order to negate a using Civil Procedure Rules (pre-action protocols).
I also reserve the right to proceed with this route irrespective of awaiting a response.

queried the Council’s response sent earlier today.
I have put your query back to the managers in our Exchequer & Welfare
Service and they have advised that the Council does not hold any further
information; that the Valuation Office deals with all appeals and that you

Dear Freedom Info,
Thank you for your prompt response, the Valuation Office said Kirklees would hold the data, the matter is not with regard to valuations or appeal of Council Tax band, but the incorrect application of said Bands for the period since 1993.
I shall now proceed accordingly to ascertain who holds what information and the accuracy of it using the necessary legal procedures.
