I am in receipt of your request for information dated 05/04/2013 concerning Lightning Protection on the Kingsteignton - Newton Abbot bridge.
Under the Freedom of Information Act and the Environmental Information Regulations you are entitled to be informed as to whether or not Devon County Council holds the information you have requested, and if so, to have this information communicated to you within 20 working days.

I visited this bridge today and can report this bridge is NOT compliant to the BS-EN 62305-2008.
However, there is sign of improvement over the Exeter Chiefs Rugby Ground which is ZERO Compliant.
I wonder which one of these bridges will use BODY BAGS First

I am writing to request an internal review of Devon County Council's handling of my FOI request 'Kingsteignton Quay Bridge'.
Please ensure the your original vexatious decision is published on this website and I now request a review of your decision based on the fact that no person applying a right and proper mind could have reached a vexatious decision which part of a wider conspiracy by the DCC to pervert the Course of Justice.
This is one of several bridges built by the DCC which are devoid of any Lightning Protection Systems AND Lightning Risk Assessment.
I was recently informed by the DCC H&S Chief Margaret Bulluck that the DCC takes Health and Safety issues seriously . I don't think so Tim??!!

I write having received your recent complaint regarding Devon County Council's response to Information Request Reference 03713. Having now assessed your complaint I can see that you are in disagreement with the Council's contention that your request was vexatious / manifestly unreasonable under the terms of the Environmental Information Regulations. I will therefore limit the scope of my investigation to specifically address this particular point. If you wish for me to consider further points regarding the Council's response please do come back to me as soon as possible.

The DCC have sent me their response to the above FOIA request via the post and not by this website. Is this another ploy by the DCC to cover up their ridiculous VEXATIOUS decisions?!
They claim the Kingstiegnton Bridge is FULLY compliant to Lightning Regulations but that's what they said about the Rugby Bridge, which we now know to be factually incorrect, don't we Mr Lawrence?!
At this Juncture, I have not visited this particular Bridge but I shall be making a visit next week.
It's hardly surprising the DCC haven't responded to the above FOIA request via this site because their response clearly and irrefutably claim it is ME who they consider vexatious not my requests.
They also consider my above request lacks serious purpose and would be "burdensome" on their resources. What a load of old codswollop.
I wonder if they will consider my request lacks serious purpose if they have need for a 1/2 doz body bags because the Bridge is struck by lightning whilst a local walking group was passing over the Bridge.
I would argue that the provision of the soughtafter data would be less burdensome than their current response??!!
Yet another clear example of the DCC circumventing the FOIA 2000.
I would suggest that my original requests for this particular bridge is straigtforeward and benign and is a BRAND New FOIA request, therefore CANNOT be seen as either Vexatious or Manifestly Unreasonable.
Message to Mr Lawrence. Please ensure your response to my above request is published via this website with an explanation why you didn't do so in the first instance please.
Isn't it ironical that the DCC are now using the GIA/3037/2011 Dransfield v ICO&DCC as their Court Authority for yet another "WHIMSICAL VEXATIOUS DECISION".
