Kingshill House, Dursley - covenants etc

The request was refused by Stroud District Council.

Dear Stroud District Council,

Please can you tell me:

1) what legally-enforceable restrictions there are on the purposes that Kingshill House, Dursley, GL11 4BZ may be used for?

2) may I have a copy of any covenants or similar restrictions that apply to the property, e.g. arising from the transfer of the house from RA Lister's to Dursley RDC's ownership etc.?

3) is it permissible for any part of the property be used for commercial, for-profit purposes under the terms of any such covenant etc. and if so to what extent?

Yours faithfully,

Chris Lambert

Stroud District Council

Dear Mr Lambert,

Ref No: 4094

Further to my e-mail to you on Wednesday 24^th May, I am now able to
respond to your request.

1) what legally-enforceable restrictions there are on the purposes that
Kingshill House, Dursley,  GL11 4BZ may be used for?

The Council’s title to Kingshill House, Dursley (‘the property’) is
registered at the Land Registry under title number GR297257.  This is an
open register and the Office Copies will show or refer to all restrictions
on the title to which the property is subject.

The Land Registry can be contacted as follows:-

·         by post to Twyver House, Bruton Way, Gloucester. GL1 1DQ

·         by ‘phone to 08435040507

There is also useful information about using the Land Registry facilities
available online
at:-[1]https://www.gov.uk/government/organisati...

2) may I have a copy of any covenants or similar restrictions that apply
to the property, e.g. arising from the transfer of the house from RA
Lister's to Dursley RDC's ownership etc.?

Please see the response to 1) above as the same applies to covenants on
the title.

3) is it permissible for any part of the property be used for commercial,
for-profit purposes under the terms of any such covenant etc. and if so to
what extent?

This is not a request for recorded information but legal advice which
unfortunately the Council is unable to provide to members of the public.

If you are dissatisfied with the handling of your request, you have the
right to ask for an internal review. Internal review requests should be
submitted within two months of the date of this letter and should be
addressed to me. The review request will then be referred to the Legal
Services Manager for consideration.

Kind regards,
