Dear Wirral Metropolitan Borough Council,

I'm aware the previous contract between WBC and Kingdom ended on 30.06.2018 -I'm also aware this contract didn't delegate authority for Kingdom "Officers" to issue fines, on Wirral, for smoking in alleged works' vehicles.
As a friend of mine has been fined for smoking in his van (not a work vehicle, leisure only) can you please advise the date that the contract came into force, delegating such powers to Kingdom?

Please be advised that the Environmental Enforcement Contract came in to
force on 1 August 2018.  At this point in time, Kingdom Services do not
enforce Smoke Free legislation.

Dear Wirral Metropolitan Borough Council,

Many thanks for your response. You say that the new contract came into force on 01st August - it has since been advised through another FOI that the new contract was actually signed on 23rd August. Which date is actually correct?

As the previous contract expired on 30/06/2018 can you please advise under what authority Kingdom were acting when they were issuing FPNS whilst they were out of contract? Can you also provide updated copies of the delegation of authority covering the out of contract period and also the new contract.

In your response you advise that Kingdom are "not currently enforcing smoke free legislation for WBC". The redacted contract published on the WBC website, as well as the article in WBC's "Wirral View" both suggest Kingdom WILL be enforcing smoke free legislation on Wirral. Please advise whether your response or the website/article is correct and also why there seems to be such confusion about a straightforward and simple issue.

You have advised a colleague of mine to request a copy of Kingdom's public liability insurance from Kingdom. Legally, you must have received a copy of this from Kingdom and as a government body I would suggest the onus is on you to provide a copy of the same to your council tax payers, not an unregulated private limited company. Please provide a copy per this request.

Thank you for your recent Freedom of Information enquiry regarding Wirral Council's contract with Kingdom Service Group Limited.

Wirral Council's current contract with Kingdom Services Group Ltd commenced on 1 August 2018. The previous contract was extended for the duration of July 2018 prior to the expiry of that contract.

Kingdom Services began actively enforcing smoke free legislation on Wirral on 30 August 2018.

Delegation of authority documents are attached. The insurance document that you have requested is information belonging to Kingdom Services Group Ltd and not to Wirral Council and therefore the Council is unable to release this to you as requested.

You have the right under Section 17 of the Freedom of Information Act 2000 to ask for an internal review of the refusal of the information requested. Please direct any request for an internal review to [Wirral Borough Council request email] and your request will be allocated for review.
