Kilroy episode featuring my late father

Dear British Broadcasting Corporation,

I would like to request an episode from between 1992-1993 featuring my late father Stephen Hillman. He may have appeared alongside David Ward. He was a freedom fighter/human rights activist captured and held captive in nagaland. He appeared on Kilroy after being released and I have never seen the episode as it aired before I was born. I do not have other videos of my dad’s voice, please help me finally have this lost footage in order to make a documentary piece detailing my father’s life

I don't understand their refusal under section 40(1) (personal
information) - the request is in relation to someone who is deceased, I am pretty sure that the mentioned GDPR would not apply to them?

ICO guidance states that "the exemption cannot be used for
information about, and which identifies, deceased individuals"

So they cannot rely on section 40.

Technically they can rely on the journalistic exemption, but there is nothing to stop them providing the information outside of the act. It's a TV show no one in the video would have an expectation of privacy. Bit low of the BBC to not release the video in the circumstances.
