Please note that due to the emerging Coronavirus pandemic Northamptonshire
County Council will have difficulties in responding to requests received
under the Freedom of Information Act or the Environmental Information

I am writing to you in respect of the Freedom of Information request below
that you previously submitted to Northamptonshire County Council which was
subsequent to the COVID-19 outbreak.

 

As we have previously stated, we had reviewed the way in which we were
processing requests due to allocation of resources within the
organisation. I am writing today to confirm that we are now in a better
position to complete your request should you still want the information.

Dear Freedom of Information,

Thank you. I apologise, I should have specified the property to which I referred was 'NCC street furniture'.

I note 'KierWSP is based on Actual Cost plus Service Providers Margin, that you have no
absolute pricing schedules for repair. This appears to be a 'cost-plus' contract.

Are there ant aspect of the 'actual costs' that appear upon a schedule. If so, I ask to be provided with these.

What is the process by which costs are reconciled pre-payment of an invoice? For example, how can you be satisfied the charge for an operative is actually their cost and not exaggerated?

What is the 'providers margin'; the figure (a percentage?), how this is calculated and if this fluctuates during the life of the contract, by what sum?

Noting KierWSP suffer no loss, they are paid by NCC to pursue Third Parties, please provide the relevant extract from the contract that sets out the conduct of KierWSP when undertaking such pursuit and who meets the costs of disbursements, such as police reports charges or lawyers fees.

there appears to be a contradiction:

I asked 'Are there any aspect of the 'actual costs' that appear upon a schedule. If so, I ask to be provided
with these.' to which the reply was:

'No, these do not exist on a schedule that we hold as actual costs may vary by supplier.'

Yet you subsequently advise:

'KierWSP supply spreadsheets for all staff that show in detail their individual salaries,
pension arrangements, NI as well as allowances for equipment provided as part of their
employment (vehicles, phones, laptops etc) and other employment associated costs. This is
agreed annually with NCC and we are at liberty to check actual salary with Kier and WSP
payroll on an open book basis. The resulting hourly rate is based on their anticipated
productive time. This applies only to the Highways Services Contract with KierWSP for the
period 2008 – 2020 only'

The spreadsheets are schedules and it is these I am seeking - for staff, operatives, plant and materials i.e. barrier (C01). I anticipate the names of the staff will be redacted and provide a schedule akin to that which I have been supplied by Kier for another area comprising the costs associated with:
Wages & Salary
Bonus & Incentives
specialist allowances
absence due to sickness and holiday
 Travel
relocation
medical examinations
Protective clothing
N.I.
meeting legal requirements
pensions and life assurance
general training
Safety training
Water
Gas
electricity
consumables for vehicle

The rates are not commercially sensitive:
they are associated with each claim, disclosed to Third {Parties
have been provided by Kier previously,
are in the public domain - Area 3 (Highways England) schedule

Some items are duplicated yet the rate, whilst different, is still associated with a ‘W’ . for example:

YT63RRO 3033-02 appears as ‘D’ @ 8.1, and ‘E’ as a ‘W’

This same VRM then appears as
