Re: Request for information – Freedom of Information Act 2000
Further to my correspondence of 15 September 2014, please now find enclosed information
you requested in relation to ketamine.
Trust decisions in relation to the release of information that the Trust holds are governed by
the Freedom of Information Act (FOIA) 2000, the Data Protection Act (DPA) 1998 and other
pieces of associated legislation. Therefore, you will note that some of the information
requested has not been provided. The Northern H&SC Trust considers that this information
is exempt from disclosure under Section 12 (1) of the Freedom of Information Act 2000,
above the “appropriate limit”. A manual exercise of retrieving and reviewing patients files
would be required to complete these questions. This would take a member of staff over 18
hours to manually extract the requested information from the files.
Section 12 of FOIA allows the NHSCT to refuse a request where it estimates that it would
exceed the „appropriate limit‟ to comply with the request in its entirety. The appropriate limit is
£450 and this is calculated by the time spent on the activities at the flat rate of £25 per hour
(per person) which means appropriate limit would be in excess of 18 hours.
The enclosed information has been supplied to you for your personal use under the Freedom
of Information Act 2000 and remains protected by copyright. You do not have an automatic
right to re-use the information, e.g. for commercial purposes or by publishing or issuing
further copies of the information unless you have received permission from the Trust. If you
wish to apply for such permission, you should write to the Chief Executive at Trust

If you are dissatisfied with the Trust‟s decision regarding your request, you may request a
review of the decision by writing to me within two calendar months of the date of this letter.
You also have the right of appeal to the Information Commissioner, by putting your complaint
in writing to the following address.
