Dear Mr Braithwaite

Thank you for your request for information. Please accept my sincere
apologies for the delay in replying to you. I appreciate we have not
complied with statutory timescales on this occasion.

There is no specific policy or procedure which instructs Kent County
Council employees as to when they should or shouldn't make a record of a
conversation they have had with a member of the public and it would be up
the the officer involved to decide whether there was any business need to
formalise any details such as date and time of call, what was discussed
etc. Therefore, KCC does not hold the information you have requested.

With regard to physical recording actual telephone conversations
themselves (by tape or digitally), Kent County Council is governed by
legislation such as the Regulation of Investigatory Powers Act 2000 and
the Data Protection Act 1998 and is obliged to ensure that the caller is
informed before any dialogue commences that their call will be recorded
and for what purpose. The Data Protection Act 1998 also applies to the
processing and sharing of an individual's personal data and KCC can only
share personal information with third parties (this could include another
KCC department) if certain conditions are met.
