Kent County Council

Dear Master Powel,

Thank you for your request for information made under the Freedom of
Information Act (FOIA) 2000, relating to private and public acts. Please
see the response below:

It is not clear on what information you are seeking, for example: do you
seek a list of legislation that Kent County Council (KCC) is subject to or
are you looking for legislation that KCC has been responsible for bringing
into UK law? Either way Information relating to Acts of Parliament are
published on line and therefore under section 21 of the Freedom of
Information Act 2000 we are not obliged to comply with your request
because the information is accessible to an applicant by other means. More
information can be found via the following links:
[1]http://www.parliament.uk/business/bills-...

Texts of Acts of Parliament as originally passed by Parliament since 1988
are available on the Legislation.gov.uk website. The Parliamentary
Archives has copies of original Acts from 1497.

o [2]Legislation.gov.uk
o [3]Contact the Parliamentary Archives

Depending on the scope of your request you may find the following links
helpful in relation to a couple of pieces of Kent legislation. Please note
this is not a comprehensive list, as this information is not held by KCC
in that format. To locate and collate a full list of Kent specific
legislation will take a considerable amount of officer time and as all
legislation is readily available, we would rely on the section 21
exemption as described above:

[4]http://services.parliament.uk/bills/2010...

[5]http://www.kent.gov.uk/__data/assets/pdf...

If you are unhappy with this response, and believe KCC has not complied
with legislation, please ask for a review by following our complaints
process; details can be found at this link
[6]http://www.kent.gov.uk/about-the-council...
on our website. Please quote reference FOI/16/0495.

If you still remain dissatisfied following an internal review, you can
appeal to the Information Commissioner, who oversees compliance with the
Freedom of Information Act 2000. Details of what you need to do, should
you wish to pursue this course of action, are available from the
Information Commissioner’s website [7]http://www.ico.org.uk/concerns.

Yours sincerely

Dear Master Powel

Thank you for your email below and attached. Please accept my apologies for the delay in acknowledging your correspondence.

I am sorry you are unhappy with KCC’s response to your request for information, and that you could not locate the legislation you were looking for using the weblink we provided you with.

An independent officer who was not involved with your original request will investigate your complaint and review our original response on behalf of the Head of Paid Service. Their reply will be forthcoming within 20 working days from receipt (by 23rd May 2016).

In the meantime, you may be interested in perusing all enacted UK Legislation http://www.legislation.gov.uk/. Kent County Council does not have any jurisdiction over Kent Courts (which is a Central Government function https://www.gov.uk/government/organisati...) and does not have the power to create or pass laws or Acts.

Best regards

Dear Kent County Council,

This is not a complaint just clarification of what information is required that your council should hold.

Yours faithfully,

master powel

Kent County Council

Dear Master Powel

You asked for “any Kent County Court Act brought in privately by KCC that
are not available on-line”

We do not understand what you mean as Kent County Council does not have
the power to create or pass laws or Acts, nor does it have any
jurisdiction over Kent courts (which come under the Ministry of Justice, a
Central Government function
[1]https://www.gov.uk/government/organisati...).
As we have previously advised you, all enacted UK Legislation, including
Acts that apply specifically to Kent County Council, are available from
[2]http://www.legislation.gov.uk/ (type Kent County Council in the search
engine). As this is information that is in the public domain already, it
is exempt under section 21 of the Freedom of Information Act 2000.

We have asked you to clarify exactly what information you are requesting
access to, if not the above, but you have failed to do so. Consequently,
we cannot comply with your request. If you remain unhappy, you can appeal
to the Information Commissioner, who oversees compliance with the Freedom
of Information Act 2000. Details of what you need to do, should you wish
to pursue this course of action, are available from the Information
Commissioner’s website [3]http://ico.org.uk/concerns, or you can phone the
ICO Helpline on 0303 123 1113.

Dear Master Powel

Thank you for your email and for being more specific about your
requirements.

Both the Kent Quarter Sessions Act 1962 and the Kent Quarter Sessions Act
1966 are Acts of Parliament and a copy of the legislation is exempt from
disclosure under section 21 of the Freedom of Information Act 2000 as the
information is already in the public domain and accessible to you by other
means. Please visit the links given to you in earlier responses. However,
for your information, the County of Kent Act 1981 repealed the entirety of
both Acts and a copy of this is attached for ease of reference, although
this too is accessible to you by other means and therefore outside the
scope of FOIA also.

The Kent Library and History Centre do hold records produced by Kent
Quarter Sessions and various Magistrates Courts in Kent, but these are
routine judicial records produced by the Court, not the national
legislation that governed how they operated. Please browse the online
catalogue [1]http://www.kentarchives.org.uk/CalmView/... for more
information.

If you remain unhappy, you can appeal to the Information Commissioner, who
oversees compliance with the Freedom of Information Act 2000. Details of
what you need to do, should you wish to pursue this course of action, are
available from the Information Commissioner’s website
[2]http://ico.org.uk/concerns, or you can phone the ICO Helpline on 0303
