July 13 2010 Day Unit. Non-disclosure events that duty of candour now requires
Dear York Teaching Hospital NHS Foundation Trust,
I would like to find out the count of:
- whistleblower-related incidents
- never-event incidents
- serious incidents
- patient injury incidents
- incidents where the patient has not yet been told of an incident
involving them (for example the Duty Of Candour laws did not exist on this date to require notification, but it is now in effect)
- incidents where full patient disclosure has secrecy act in place preventing full disclosure under a subject access request under 1998 data protection act.
This only related to the Day Unit Theatres on JULY 13 2010 and only patients undergoing a laparoscopic procedure that day.

Dear Freedom of Information Requests,
A relative walked into hospital for an operation in the date mentioned and has been paralysed since with a spinal cord injury that she has had trouble getting a diagnosis from for whatever reason. When she exercised her right under the data protection act/subject access request for all paperwork, she was told not all of it could be provided and was quoted the law in which some of it cannot be provided. The law quoted to her by numerical reference was the Secrets Act amendment providing protection to NHS whistleblowers.
This clearly does not balance alongside your response to this FOI request. We believe the lack of transparency on what has happened to be attributing to on-going suffering because something is still being hidden. You'll also note crash-call data you've released on a previous FOI for the same date and ward of my enquiry on this website does not balance.
Something is not right here.

In response to your further enquiry of 1st September, we are keen to help you but are unable to locate the information you seek without more specific information.
We have made every effort to identify the incident on the basis of the information you have supplied but without success. May I reiterate our original recommendation, that you contact this office directly with fuller information it may not be appropriate to share on a public website.
This office has comprehensive policies and procedures for compliance with all applicable access to information legislation and I will be pleased to look into the matter once furnished with enough identifying data. Please note that medical records will normally be made available to the patient themselves or to their representative, with evidence of consent or other entitlement.
