Judicial Review prior to IOPC assessment of PCC and PSD?

Independent Office for Police Conduct did not have the information requested.

Dear Independent Office for Police Conduct,

Prior to judicial review must the IOPC review PSD and PCC decisions which fall within the IOPC remit of criteria to investigate? For example, refusing to take a statement regarding NFIB disseminated matters, malfeasance and dishonesty on public office, claiming ECU officers had been appointed to investigate when they hadn't been appointed?

1) Can you supply legislation about police and crime commissioners refusing to state whether a right to review a sub standard investigation lies with the IOPC or whether a complaint goes straight to judicial review by leapfrogging the IOPC

2) does PSD and the PCC have a duty to state in any final letter of response whether there is a right of appeal, and if so, to which body

3) if a complaint about sub standard investigation of a matter disseminated by the NFIB has been assessed by the PCC does that assessment immediately prevent the IOPC looking at the matters? In other words does an individual have a choice a) PSD pass it to PCC or b) PSD pass it to IOPC?

It is clear from your request that you are seeking our confirmation as to
how rules and procedure should be applied to a specific case in which you
are involved.  By setting out a particular set of circumstances and then
asking for our confirmation as to how the police complaint rules apply to
it, you are effectively making a request for advice. Such advice could not
be given without considering all the relevant evidence that defines the
context in which each question is being asked.   Any information we gave
on that basis would consist of opinion or advice that we would have to
create in response to your request.  Therefore we do not hold the
information you require.
 
Our obligations under FOIA do not extend to engaging in general
discussion, arguing for or against any particular position or creating any
other information that is not already held in recorded form, especially
when this involves the personal circumstances of the requester.   The FOIA
is not the appropriate mechanism for seeking confirmation about what
should or should not happen in any specific case with a view to applying
our response in any on-going grievance or dispute.  
 
In the interests of providing advice and assistance however, we can say
that if you wish to challenge any decision made by a public authority in
relation to a personal case you should seek your own independent advice
and address your issues through the appropriate channels.
