Freedom of Information Act (FOIA) Request –
Thank you for your request received on 10th June 2023 in which you asked for the following
information from the Ministry of Justice (MoJ):
Further to your response to Freedom of Information Act (FOIA) Request no 230306053
on 23 March 2023 you state
"I can confirm the MoJ holds some of the information you have requested under
paragraphs 1 and 3A.
With one exception, the Ministry of Justice and its associated departments do not give
advice to courts, legal advisors or justices, or justice clerks society, on law or procedure,
as that is not the function of the civil service...
The exception is the Justices’ Legal Advisers and Court Officers Service (JCS), which is
funded by HMCTS and gives advice to justices’ legal advisers which is independent of
MOJ and HMCTS under section 29 of the Courts Act 2003"
Your title is:
Head of Legal and Professional Services | Secretary, Justices’ Legal Advisers and
Court Officers’ Service (formerly the Justices’ Clerks’ Society)
1 - Can you please provide information as to why the title Justices' Clerk Society is used
on the recent update on procedures regarding Liability Orders and
2 - Information you hold authorising this direct interference by Government in the affairs
of the Courts which is not authorised by the Constitutional reform Act 2005 which
confirms no interference in the independent judiciary, and supercedes the Courts Act
2003.
Your request is being handled under the FOIA.
The MoJ is required to provide you with a response within 20 working days. I will send you a
response to your request by 7th July 2023.
