Dear Ministry of Justice,

Can the MOJ provide a copy of your policy that shows that judges acting under their oath of office and not those acting as agents for HMCTS are required to follow the DPA 2018 and the GDPR to protect living individuals data protection rights.

Are those acting as judges in the county court as agents for HMCTS also required to comply with the data protection laws or are they exempt because they make decisions on behalf of the county court and not a judicial decision as a judge.

Does anyone one whether the GDPR and DPA 2018 applies to both the courts and to their agent judges?

If it does why would they charge a data subject to obtain their data when it is free under the DPA 2018?
