JSP 900 Current Edition. Re-submission
Dear Ministry of Defence,
With regard to the MOD Internal Review response dated 8 October 2021 (FOI 2021 02770) in which MOD advised that I resubmit this request after a period of three months please see resubmitted request below.
This a request for information under the Freedom of Information Act 2000
1. Please identify the edition number and date of the current edition of JSP 900.
2. Please provide a copy of the current edition of JSP 900.
3. If only the current edition can be considered for release within burden limits, please confine the request to that edition. If it is not overly burdensome, please also provide any other editions of JSP 900 held (disregarding JSP 900 edition 2, September 2015) with priority given to most recent editions. For instance if edition 4 is the current version, please provide it and only then if not too much of a burden please provide a copy of edition 3, and only then edition 1.
4. In considering the above request please take into account the ICO Decision Notice FS50882580 dated 26 February 2020, which discusses the Commissioner's view on the public interest arguments for release of these documents as of that date.

I am writing to request an internal review of Ministry of Defence's handling of my FOI request 'JSP 900 Current Edition. Re-submission'.
It is unacceptable that the MOD has just one person to deal with FOIA requests of this nature, and to rely on this lack of resource as a justification to refuse a FOIA request under section 14.
MOD has statutory obligations under FOIA to provide information to the public, and especially in times of growing conflict - in which this country appears to be participating - must be accountable to the public for its current targeting policy, direction and guidance. The public interest in disclosure is overwhelming in this case. Please reconsider this decision.

1. The complainant has requested a copy of JSP 900: the UK targeting
policy from the Ministry of Defence (‘the MOD’). The MOD refused the
request on the basis that section 14 of FOIA applies (vexatious request).
2. The Commissioner’s decision is that the MOD was not correct to apply
section 14 to refuse the request. He has also decided that it did not
comply with the requirements of section 17 of the Act in that it did not
provide its response within 20 working days of the date of receipt of the
request for information.
3. The Commissioner therefore requires the MOD to take the following
step:
To respond to the request again, without relying upon section 14
of FOIA.
4. The MOD must take these steps within 35 calendar days of the date of
this decision notice. Failure to comply may result in the Commissioner
making written certification of this fact to the High Court pursuant to
section 54 of FOIA and may be dealt with as a contempt of court

Even if exemptions were properly applied, where a public interest test has been applied I challenge the weight placed in the balancing of public interests and result of those public interest tests.

23(1) (security bodies), 24(1) (national security), 26(1)(a) and (b) (defence), 27(1)(a) and (b) (international relations) and 40(2) of FOIA.
2. The Commissioner has concluded that the redacted information is exempt from disclosure on the basis of sections 23(1), 26(1)(a) and (b), 27(1)(a) and (b), and 40(2) of FOIA.
3. The Commissioner does not require any steps to be taken.
