I have contacted the MOD and asked it to respond to your request within

compliance function. This helps us meet the goal in our ‘Openness by
Design’ strategy to improve standards of accountability, openness and
transparency in a digital age. We aim to increase the impact of FOIA and
EIR enforcement activity by targeting public authorities’ systemic non-
compliance.

Decision (including any steps ordered)
1. The complainant requested information from the Ministry of Defence
(MOD) about historical editions of JSP 398. By the date of this notice the
MOD had not issued a substantive response to this request.
2. The Commissioner’s decision is that the MOD has failed to complete its
deliberations on the balance of the public interest within a reasonable
time and has therefore breached section 17(3) of FOIA.
3. The Commissioner requires the MOD to take the following step to ensure
compliance with the legislation.
• Having confirmed whether or not information is held within the
scope of the request: either disclose the requested information, if
held, or, to the extent that information is to be withheld, issue a
refusal notice in accordance with the requirements of section 17 of
the FOIA.

4. The MOD must take this step within 35 calendar days of the date of this
decision notice. Failure to comply may result in the Commissioner
making written certification of this fact to the High Court pursuant to section 54 of FOIA and may be dealt with as a contempt of court.

I am writing to request an internal review of Ministry of Defence's handling of my FOI request 'JSP 398 (August 2013 Edition) and JSP398 (March 2017 Edition)'. (FOI2023 03106)

1. I challenge the application of all cited exemptions from disclosure to all the redacted information.

2. No explanation is given for the absence of Part 2 of the March 2017 Edition or under what section MOD has withheld it from disclosure.

3. There is a vital public interest in the disclosure of the redacted and withheld information in this case in order that UK ROE can be independently scrutinised in light of the fact that their remain serious unanswered questions as to UK adherence to its obligations under international and domestic law.

Receipt is acknowledged of your email of 9 August 2023 requesting an
internal review of a response provided by the Security Policy Operations
Secretariat and Communications on behalf of the Ministry of Defence under
the Freedom of Information Act, dated 1 August 2023 (our reference above).

 

The Department's target for completing internal reviews is 20 working days
from date of receipt and we therefore aim to complete the review and
respond to you by 7 September.  While we are working hard to achieve this,
in the interests of providing you with a realistic indication of when you
should expect a response, the majority are currently taking between 20 and
40 working days to complete.

 

The review will involve an independent assessment of the handling of this
request and the outcome.

Thank you for your enquiry. As indicated in the wording of the acknowledgement, having not achieved our 20-working day internal target date for the completion of this internal review, we are now working to complete this internal review in a further 20 working days (i.e. by 5 October). Unfortunately, due to the availability of subject matter experts and the heavy demand on our services at the moment, it is unlikely that we will meet this target and will require some time in addition but please rest assured we are reviewing this case as quickly as we possibly can in the circumstances.
