Under FOIA 2000 can you please confirm if this is the only press release that Northumbria Police and/or MI5 aka Security service released concerning me during September 1997?

I don't expect Northumbria Police to reply to this request given they have not replied to others I have made. Northumbria Police are of course breaking the law by failing to dealt with FOI request's. However, there is nothing new in that, NP have been breaking the law with me, my cases for over 20 years. The lies, the cover-ups, the smears, dirty tricks, failing to investigate serious corruption by its Top cops, failing to investigating my attempted murder, willfully covering up PIRA (terrorist) involvment in my attempted murder, protecting the PIRA terrorists who attempted to murder me etc ...

We have now had the opportunity to fully consider your request and I
provide a response for your attention.

In response to your Freedom of Information request dated 23rd November
2013, I would like to point out the following.

The Freedom of Information Act is a piece of legislation which quite
rightly opens up public authorities to greater scrutiny and accountability.

Under the provision of the act an authority must process a request in
writing from a named applicant under the terms and conditions of the
legislation. Previous requests relating to your case have been declared
vexatious. Whilst giving maximum support to individuals genuinely seeking
to exercise the right to know, the Commissioner's general approach will be
sympathetic towards authorities where a request, which may be the latest in
a series of requests, can be characterised as obsessive or manifestly
unreasonable.

You should therefore consider this to be a refusal notice under Section 17
of the Act for your request.

You may be interested to know that Northumbria Police routinely publish
information via the Disclosure Log. The aim of the Disclosure Log is to
promote openness and transparency by voluntarily placing information into
the public arena.

The Disclosure Log contains copies of some of the information that has been
disclosed by Northumbria Police in response to requests made under the

Martin McGartland cases and the Serious corruption by Northumbria Police...

Northumbria Police continue to cover-up Martin McGartland's attempted murder. Corrupt 'officers' within Northumbria Police HQ are even lying and concealing PIRA, terrorist involvement in the attempted murder. Bent NP cops continue to cover-up, conceal DNA evidence, information and evidence connected to the 2 handguns and ammunition (as well as other compelling evidence). This is being done (on orders of MI5, HMG) so that they can protect IRA terrorists who tried to murder Martin McGartland.

This is also being done on the direct orders of Corrupt Sue 'Sin' Sim, Chris 'the fixer' Thomson and other corrupt cops (including bent members of NP's so-called Special Branch). Vera Baird QC, PCC continues to look both ways when it concerns Martin McGartland's cases. Why? Marty McGartland said; "It is corrupt to ignore corruption and or to turn a blind-eye to it."

This is both a complaint and also a request for an Internal Review.

Dear Northumbria Police,

You refer to the flawed (and engineered)vexatious notice that was issued by NP and rubber stamped by individuals within Home Office and ICO. It needs to be pointed out that the Home Office have very good reason for wanting to cover-up in my case.

It was the Home Office, MI5 along with Northumbria Police (and CPS) who cooked-up the 1997 Malicious prosecution against me. Each of them played their part in reading out my home address in open court. The information was then published in the national newspapers.

I was of course was acquitted of the trumped up charge. It was that case that lead PIRA terrorists directly to my home. As a direct result, the PIRA shot me no fewer than 6 times. I am not dealing in hearsay, the above are facts.

Since the day of my attempted murder Northumbria Police have been covering up PIRA terrorist involvement even when they have had evidence (from almost day one) to show PIRA was involved. Northumbria Police, MI5, Home Office and HMG have done everything possible to cover-up IRA involvement. They have also been protecting the terrorists who tried to murder me.

On the very day of my shooting Northumbria Police were involved in a disgraceful Smear campaign against me. This was at a time when I was fighting for my life. The following, again facts, in the form of 3 independent sworn signed witness statements which confirm same; (Northumbria Police "Banged to rights" in the Martin McGartland case; http://www.scribd.com/doc/199128793/Smea... ) These are important to this complaint and also my request for an Internal Review.

I suspect that NP legal department (who have been party to the cover-up) will again ignore the above evidence (as will those within NP PSD and the ICO).

Regards the flawed (and engineered)vexatious notice that you refer to, that which was cooked up between NP, Home Office and the ICO. I note you have not included a copy of the 2009 notice. Please ensure you do so when replying with your (I should say your Legal Departments) findings/whitewash to this Internal Review. I suspect NP is embarrassed by their 2009 notice, that being reason why it was not included, attached to above reply.

From memory the flawed (and engineered)vexatious notice that NP issued to me was back in 2009, over 4 years ago, almost 5 years ago) related to the first request I ever made for information concerning my attempted murder case. I did this after NP refused to give me any information , as the victim, on my case. .

When dealing with this complaint I would expect NP to deal with the fact that the flawed (and engineered)vexatious notice was issued between 4 and 5 years ago. I also expect NP to deal with the delay in dealing with the request given they have given no reason at all for the delay nor why they ignored further messages I sent them asking for reply.

Moreover, I am requesting that NP also investigate the above, that NP are using flawed (and engineered)vexatious notice simply to cover-up their own wrongdoing. That they are abusing the FOIA 2000 and are also breaking the law. If NP have nothing to hide or if they believe they have done nothing wrong they should have no difficulty in carrying out a proper investigation in to this complaint and Review.

The truth is that NP have never properly investigated any of my complaints I have made during the past 17 years. Each, every complaint I have made has been whitewashed and or by corrupt NP officers.

Given above, I am requesting that NP deal with the 2009 flawed (and engineered)vexatious notice, in particular. That 2009 notice was issued almost 5 years age. It is unlawful for NP to continue using it as a blanket ban and/or reason to refuse each/every request I make. They can not use a 2009 notice to prevent me from making lawful FOIA request/s, requests concerning me, my attempted murder case, as the victim of a crime

The FOIA is very clear regards vexatious requests, and or notices and they cannot nor should they be used as a blanket reason to refuse requests or to cover-up wrongdoing.

The Home Secretary has told a court that she dare not confirm or deny that Martin McGartland was a British agent in case providing such information would endanger his life or even damage national security.

Mr McGartland, one of the best-known undercover agents to operate during the Troubles, spoke of his frustration over Theresa May's stance, saying: "This is one of the daftest things I have ever heard; everyone who is interested knows my past."

Mr McGartland was a former RUC and MI5 agent within the IRA in the 1980s and 1990s.

"It is 23 years since I worked as a undercover agent," he said.

"No current security interest is at stake. Besides, I have written two books about it since then. One was made into a film (50 Dead Men Walking).

"I have featured in six TV documentaries and numerous newspaper articles. The IRA captured me once and nearly killed me in a gun attack.

"The authorities wrote to the BBC back in 1997 admitting that I had been resettled and was being protected because of my service to them. I wonder how well briefed the Home Secretary is?"

Ms May, whose department is responsible for MI5, signed the application in a court case brought by Mr McGartland and his partner Jo Asher. The pair now live under secret identities provided by MI5.

He even has a contract signed by the organisation in which representatives of two police forces – Northumbria and the PSNI – acknowledge his service in general terms. This agreement was signed after he was shot in England.

Mr McGartland is disabled and suffers mental trauma as a result of the attacks on him. Ms Asher cares for him full-time. She is also unable to prove her qualifications because they are held in a different name.

The couple are unable to claim many State benefits because he can't admit the cause of his trauma or his gunshot wounds for security reasons. For a time, MI5 made up the shortfall, but that facility was withdrawn after he gave an interview to the Belfast Telegraph.

And Mr McGartland has had psychological counselling withdrawn despite reports from a Government-nominated psychiatrist that he needed it, and was suffering personality changes.

"Refusing to confirm or deny my role is simply a trick to avoid the State's responsibilities toward someone who has risked his life for it," he told the Belfast Telegraph.

BACKGROUND

Martin McGartland is one of the best-known undercover agents or informers to have worked during the most recent Troubles. From a republican family, he never sympathised personally with the IRA and turned strongly against it when other young people he knew were kneecapped or beaten by the organisation. He was a Special Branch and MI5 agent in west Belfast from 1987-1991. In 1989 he joined the IRA at his handler's request. His cover was blown when he averted a gun attack on off-duty British soldiers in a Bangor pub and the IRA deduced that he was an MI5 mole.
