Dear North Yorkshire Police and Crime Commissioner,

You are requested to disclose the following information under the Freedom of Information Act. The questions relate to the Joint Independent Audit Committee (JIAC) and cover (a) the financial year 2016/17 and (b) the current financial year to date 2017/18.

1. How, where, and when (how many days prior) are the meetings of JIAC are publicised?

2. How many members of the public attended JIAC meetings during the two financial periods, broken down by meeting?

3. How many accredited members of the press attended JIAC meetings during the two financial periods, broken down by meeting?

4. On the occasions that (i) the chief constable (ii) the PCC did not attend the JIAC meeting, the reason given for their apology for absence.

For the avoidance of doubt, a search has been made of the PCC's website under 'Events' and 'Julia's Diary' and no reference to JIAC meetings can be located.

Dear North Yorkshire Police and Crime Commissioner,

Please pass this on to the person who conducts Freedom of Information reviews.

I am writing to request an internal review of North Yorkshire Police and Crime Commissioner's handling of my FOI request 'Joint Independent Audit Committee'. These are the grounds for complaint:

1. It is noted that, yet again, NYP has breached its statutory obligations under section 39A of the Police Act, 1996 (College of Policing's Code of Ethics). Authorised Professional Practice (APP) requires you to respond to information requests PROMPTLY. Or, in any event, within 20 working days.

2. APP also requires that police forces communicate effectively and explain any contemplated delays.

3. The Act, at Section 10, also requires public authorities to respond PROMPTLY

4. Neither Parliament, nor the College of Policing, contemplated that North Yorkshire Police and the North Yorkshire Police and Crime Commissioner would, habitually, rush out poor quality responses to requests on the afternoon of the 20th working day.

5. Turning specifically to the request, the response at question 1 is false: NYPCC clearly holds no information, or records, concerning the publicising of the Joint Independent Audit Committee (JIAC) meetings.

6. On any independent view (for example that of a Tribunal judge), the inclusion of future dates WITHIN the minutes of the JIAC meetings (located in an obscure corner of the PCC's website) does not constitute 'publicity' (see para 8 below), and is plainly a contrived and dishonestly grounded response.

7. One can safely draw that conclusion by simple comparison to the extensive, and persistent, publicity applied to Scrutiny Board meetings in which both the PCC and chief constable particpipate on an occasional basis.

8. The common and ordinary meaning of 'publicity' is gaining public visibility or awareness for a product, service or event (meeting), via the media (as is the case with Scrutiny Board meetings: At the very least, social media and the front page of the PCC's website). As set out above, the PCC's response at question 1 does not even begin to meet that test.

9. The dishonest manner in which this information request has been finalised is aggravated by the fact that the PCC was a professional publicist/marketing strategist, up to the end of 2013 when she finally, and reluctantly, gave up her role in the company, Sixteen Hands Ltd. She cannot, in all fairness, claim not to know what constitutes publicity.

10. Accordingly, the PCC is invited to amend the finalisation of the instant request to reflect the true position concerning the absence of any publicity for JIAC meetings.

11. Failing which, a section 50 complaint will be made to the Information Commissioner - and Code of Ethics breaches of Honesty/Integrity and Discreditable Conduct will be pursued.

This does not impact directly on the internal review request but gives What Do They Know users and readers a greater insight into the role and performance of the Joint Independent Audit Committee (JIAC).

Her Majesty's Inspector of Constabularies has published a report today that is very critical of the lack of scrutiny in NYP. Read more here:

This is precisely why the JIAC should be properly publicised and, also, precisely why the poice commissioner is keen to cover up the fact that they aren't publicised.
