John Smiths Stadium & Kevin Nagle's acquisition

We're waiting for Tom Hennigan to read a recent response and update the status.

Dear Kirklees Borough Council,
I would like to request the following information of the acquisition of the John Smiths Stadium by Kevin Nagle in 2024.

What was the process of the acquisition; in the report "Amendments and to ownership and control arrangements: Kirklees Stadium Development LTD."

In regards to the report, the statement "the restructuring will mitigate the council's liabilities" I would like to know the amount of money the council has invested into the stadium since it's opening.

Also the amount of revenue and rent that the council has received from Huddersfield Town Football Club, Huddersfield Giants Rugby League Football Club and any other events held at the stadium.

The report also refers to a proposal put forward in 2020 for increased rent which wasn't supported by HTAFC, what was the proposed new rent and was this decision made based on Covid-19 and lockdown.

In terms of 'invested' I would like to request any documents recording the council's spending on the stadium per year, any income/outgoings, during the time Kirklees Council was the majority shareholder.

I am writing in response to your request dated 31 January 2025. This has
been dealt with under the Freedom of Information Act 2000.

The Council’s response to your specific questions is set out below:

I would like to request the following information of the acquisition of
the John Smiths Stadium by Kevin Nagle in 2024.

 1. What was the process of the acquisition; in the report "Amendments and
to ownership and control arrangements: Kirklees Stadium Development
LTD."

The report sets out the rationale and the process for the changes in
control at the stadium. If the report does not provide the answers sought,
please could you clarify the question and what information you are
seeking?

 2. In regards to the report, the statement "the restructuring will
mitigate the council's liabilities" I would like to know the amount of
money the council has invested into the stadium since it's opening.

Our interpretation of the question is whether the Council has spent
anything directly on the stadium itself – The Council has not spent
anything on the physical site.

The ownership by KMC of 40% of KSDL is public record. The capitalisation
of the company was increased in 2020 to £150k in total, and under that KMC
injected c £60k at that time.

 3. Also the amount of revenue and rent that the council has received from
Huddersfield Town Football Club, Huddersfield Giants Rugby League
Football Club and any other events held at the stadium.

Nil. The Council has no relationship with HTAFC, HRLFC as regards to rent,
as this is paid to KSDL.

 4. The report also refers to a proposal put forward in 2020 for increased
rent which wasn't supported by HTAFC, what was the proposed new rent
and was this decision made based on Covid-19 and lockdown.
