Dear Merseyside Police,
I’m applying for a FOI request on information about my father, John Joseph Fogarty – an Irish national, born on 17th August 1966. He is now deceased – having passed away on 9th January 2007.
I’m now seeking information on whether he came to the attention of Merseyside Police and seek copies of any records retained by them, which document any possible association with my father for offences possibly committed.
If such information is forthcoming, I humbly request that it’s sent to me.

Thank you for your request for information concerning your late father. 
This will be dealt with under the terms and conditions of the Freedom of
Information Act and has been booked in under the local case reference
number DM2019/1322.

 

Before we proceed any further, there are two issues I need to draw your
notice to.

 

Firstly, a person born in 1966 could reasonably be expected to still be
living.  Data concerning living individuals is governed by the Data
Protection Act, which would prevent any disclosure under the FOI Act
(personal data being exempt from disclosure under Section 40 FOI Act). 
Therefore, before any disclosure can be made we need to be satisfied that
your father is indeed deceased, so I hope you will understand that we need
some form of proof from you to this effect.

 

Secondly, you are requesting what I would consider to be information that
is of personal and private interest to you, yet you have opted to submit
your request via the What Do They Know website.  You may or may not be
aware that What Do They Know immediately publishes all correspondence
which is exchanged between an applicant and a public authority, including
any final response to an FOI request.  This is managed by the site itself
and Merseyside Police has no control over it.  In the event that
Merseyside Police does hold information relating to your father and opts
to disclose it, is this information you want to have published on the What
Do They Know website for any individual to view?  If not, you may wish to
provide us with your own private email address so that the response can
only be viewed by yourself.  You can submit this to

to Merseyside Police via the What Do They Know website.
