Dear FOI Enquiries,

Please can you confirm that I have understood the situation correctly?

The request asked "Have both Jodie Whittaker and Chris Chibnall notified the BBC of their intention of leave 'Doctor Who' after their second series?"

The response states that the information is held, but the information is outside the scope of FOIA because of the derogation.

Am I correct in understanding that if the requested information was not held, then it would not be possible to apply the derogation?
