FoI request: From documentation please kindly provide the job titles of those responsible for preparing material for death inquiries to review. For example if independent consultants from Nottingham City Safeguarding Adults Board need to review how an individual came to die and DWP was somehow relevant to such an investigation what are the job titles of those who would prepare the files of such an individual for those independent consultants to check over.

I am writing to request an internal review of Department for Work and Pensions's handling of my FOI request 'Job titles for death inquiries'.

The response stated that the information I requested, specifically the job titles of individuals responsible for preparing material for death inquiries, was withheld under Section 40(2) of the Freedom of Information Act 2000 (FOIA2000).

While I appreciate the Department for Work and Pensions' (DWP) prompt response, I believe their decision to withhold the requested information is legally flawed for several reasons, including the following:

1 Misinterpretation of the Request:
The DWP's response suggests that the release of job titles would result in the identification of specific individuals involved in the preparation of material for death inquiries. However, it is important to note that my request solely sought the job titles of those responsible, without any personal or identifying information. Job titles, especially within large organizations like the DWP, are often held by numerous individuals who perform similar roles. Therefore, releasing the job titles alone would not enable the positive identification of specific staff members.

2 Lack of Contextual Information:
The DWP's response fails to provide sufficient context regarding how the release of job titles alone would breach any data protection principles or harm the rights and freedoms of the data subjects involved. It is crucial to consider that the disclosure of job titles in the context of death inquiries serves a legitimate public interest, facilitating transparency and accountability in government processes. Without specific evidence or explanations, it is unclear how the release of job titles would infringe upon the rights and freedoms of the individuals concerned.

3 Consideration of Proportionality:
The DWP's response does not adequately address the principle of proportionality in relation to the requested information. The release of job titles, devoid of personal or sensitive details, represents a minimal intrusion on individual privacy. Conversely, it serves a substantial public interest in promoting accountability and scrutiny of processes related to death inquiries. Thus, the proportionality of withholding the requested information should be reevaluated.

I kindly request a thorough internal review of the DWP's decision to withhold the requested information. I urge you to consider the points outlined above and conduct a comprehensive reassessment of my FoI request. The DWP's response should address the flawed assumptions regarding positive identification, provide a clear explanation of how the release of job titles would breach data protection principles, and offer a balanced assessment of the public interest involved.
