the Job description and Job evaluation scores for the post of 'senior

Description and Job Evaluation factor scores for relevant posts through
existing business as usual arrangements, which our HR service has in place
to facilitate Trade Union activity, including the "Working Together
Protocol - December 2015”. Further, such arrangements would simply require
that you confirm you are acting in the interests of named members and your
request is relevant to the matter for which that representation relates.

 

Under the terms of the Act, a request for information can be refused where
one or more of the exemptions listed in the Act apply. In this instance,
the Council is claiming an exemption under section 25 of the Act because
the information is ‘otherwise accessible’ to you through an established

I am writing to request an internal review of City of Edinburgh Council's handling of my FOI request 'Job description and job evaluation scores'.

I disagree with your application of exemption.

Section 25 of the Freedom of Information (Scotland) Act 2002 (FOISA) exempts information from disclosure where the requester can reasonably obtain the information without asking for it under FOISA

I made the exact same request on 30/08/19 via the "existing arrangements" you have referred to you in your response, to date the information remains undisclosed, the length of time has now become unreasonable.

It is unreasonable to challenge my duty of confidentiality i have to my members, I will not be drawn in to comment on who is or who is not a member or how i intend to represent members, see below from ACAS code;

In the context of the Data Protection Act 1998 whether a person is a member of a trade union or not is defined as sensitive personal data. This also applies to data concerning individuals, for example communications concerned with possible or actual grievance and disciplinary issues. There are therefore very strict provisions on how such data can be used and monitored in compliance with the law

As you can see i cannot reasonably obtain the information without asking for it under FOISA therefore the exemption is not valid.
