I am writing further to your request for information about the recruitment
for the job Children in Need - Team Manager - W2111 - closing date
19/06/2009. We received it on 3 August 2009. Please find our response to
your questions below.

While I can confirm that the questions exist we are not supplying them.
In not disclosing this information the council is relying upon exemption -
Section 36(2)(c) of the Freedom of Information Act. This exemption
applies where disclosure would be likely to prejudice the effective
conduct of public affairs. It may be helpful if I explain a little about
this exemption. The Freedom of information Act creates important rights of
access to publicly held information. However, there must be a balance
struck between the two extremes of total transparency and total secrecy.
The Act therefore, contains a number of exemptions which might be applied
to prevent the release of information under certain circumstances.

The section 36 exemption can only be applied by the Council's Monitoring
Officer who is the Director of Corporate Governance, Mr Philip Lloyd
Williams. In his opinion section 36(2)(c) should be applied as the
interview questions are likely to be used again in the near future for the
same or very similar posts. Therefore if the questions became publicly
known it could affect our ability to recruit the most suitable employee,
as it could give a candidate an unfair advantage over other candidates.
The Monitoring Officer has also considered the public interest in
releasing the information and concluded that it would not be in the public
interest to prejudice the Council's recruitment process.

4) A copy of any document/form or documents/forms used to shortlist
candidates for this post.

Please see the attached. You will note that the names of the candidates
are missing. We have removed the names because disclosing them would be
likely to breach the first principle of the Data Protection Act 1998. In
doing so the Council is relying upon section 40 of the Freedom of
Information Act which provides an exemption from having to release
information if doing so would be likely to breach any of the Data
Protection principles.

5) Was anyone recruited for the post?

We are in the process of appointing a candidate (not in post yet).

5.1) Was the successful candidate already an employee or agency worker, or
an external one?

The successful candidate was internal.

6) A copy of any actual Case study or computer or paper based
exercise/task used in the interview(s) or recruitment for this specific
post, in addition to any document/form or documents/forms used for scoring
or evaluating any interviewee's exercise/task.

Again, section 36 is being applied for the reasons previously mentioned
above as it is highly likely that the test will be recycled in the near
future.

7) What was the Job Title or Designation of all those who conducted or
participated in the interview(s) for this particular post.

Fieldwork Services Manager, Interim Children's Services Manager from the
Council, the Head of Children's Health Services from the Care Trust plus a
young people's panel.

Information reviews. As other local authorities have not exempted
the interview questions or interview case studies exercises asked
on social workers, I consider there is a Public interest in knowing
what types of knowledge and skills social workers should have to do
the job.

I am writing in response to your request for a review of the decision not
to supply copies of the interview questions and case study or computer or
paper based exercise/task for the post of Children in Need - Team Manager
- W2111 - closing date 19/06/2009.

In not disclosing them to you in the first instance the council relied
upon exemption - Section 36(2)(c) of the Freedom of Information Act. This
exemption applies where disclosure would be likely to prejudice the
effective conduct of public affairs and was applied because the
information was likely to be used again in the near future for the same or
very similar posts. Section 36 is known as a qualified exemption which
means that if the public interest in disclosure outweighs the public
interest in withholding the information then the information must be
released, even though an exemption might exist.

As you know the Monitoring Officer did consider the public interest in
releasing the information and initially concluded that it would not be in
the public interest to prejudice the Council's recruitment process. Upon
receipt of your appeal and the further information you have supplied to
support your arguments for disclosure the public interest has been
reconsidered and it has now been decided that the information will be
disclosed to you. I have supplied it as attachments to this email.
