Jack Straw April 2009 Child abuse whistleblower changes

The request was partially successful.

Dear Ministry of Justice,

" But as of April 2009 because of a change in legislation being introduced by Jack Straw, the Justice Secretary, the media will no longer be able to identify those involved in cases such as the Websters. It will also be illegal for any children currently to speak out, even if they feel they are being maltreated"

What changes were introduced by Jack Straw to have these effects?

Yours faithfully,

Angie Nickson

Data Access & Compliance Unit, Ministry of Justice

Dear Ms Angie Nickson,

Thank you for your e-mail, I am writing to advise you that your enquiry does not fall under the Freedom of Information regime.

It may be helpful if I explain that the Freedom of Information Act (2000) gives individuals and organisations the right of access to all types of recorded information held, at the time the request is received, by public authorities such as the Ministry of Justice (MoJ). Section 84 of the Act states that in order for a request for information to be handled as a Freedom of Information (FOI) request, it must be for recorded information. For example, a Freedom of Information request would be for a copy of a policy, rather than an explanation as to why we have that policy in place. On occasion, the Ministry of Justice receives requests that do not ask for recorded information, but ask more general questions about, for example, a policy, opinion or a decision.

Since you are asking for information what changes were introduces by Jack Straw, this will be best dealt with by the Ministerial Correspondence Unit (MCU) who will process your query as Official Correspondence. I have copied them into this e-mail but they can be contacted via the contact details below, should you wish to follow up this e-mail.:

Susan Akins,

Dear Ms Nickson

Re: Freedom of Information Request - Corporation Sole.

Thank you for your recent e-mail of 24 April addressed to The Ministry of
Justice, about the requirements needed to set up a corporation sole under
the Freedom of Information Act.

Firstly, I would like to reiterate the reply you received from the Data
Access and Compliance Unit, Ministry of Justice, on 6 November 2013, that
your enquiry does not fall within the Freedom of Information regime. That
said, I will explain what a 'corporation sole' means. A corporation sole
is a body politic having perpetual succession and which is constituted in
a single person by way of right of office or public function. They are set
up by Royal Charter or Act of Parliament although - as always - there are
some limited exceptions to the rule (e.g. the Queen and some bishoprics
are corporation soles that haven't been established by Charter or
statute).

For information on how to set up a corporation sole, you will need to seek
your own legal advice.

I hope this answers your question.

Yours sincerely
