Dear SRA Information Compliance,

The SRA website does not make it clear and transparent as to what services the SRA authorises and regulates this company J E Baring Ltd whose trading name is also J E Baring & Co .

Why is the SRA concealing whether or not this company is authorised by the SRA to carry out debt recovery work and the date you authorised them for the following as a company:

1.debt recovery services
2. statutory demands
3. bankruptcy petitions
4. charging orders
5. reserved legal activity of appearing of appearing in court for the above activities.

All that your website states is authorised for all legal services from 14 January 2020 but does not say which legal services?

Thank you for your email.

J E Baring & Co was incorporated into J E Baring Limited in 1 March 2021.

Dear Ms Ball,

Thank you for your email.

The closure date on our register should read 01 March 2021, not 2020. I am
sorry for this mistake, this has been corrected and will be updated on our
website tomorrow.

Regarding your question:
“None of these solicitors or as prior partners of their partnership or the
company are listed on the Law Society for debt recovery work neither are
they listed for debt and bankruptcy - personal work are the SRA claiming
the Law Society register is Incorrect.”

I note that you have received a response from the Law Society regarding
their register in which they have stated:

“The Law Society’s Find A Solicitor register is aimed at consumers and is
drawn from the SRA regulatory record, but can also be expanded by members
beyond the core regulatory information to highlight areas of practice,
accreditations or other skills (e.g. languages spoken) to help consumers
choose a solicitor to assist them. The areas of practice which show on
Find a Solicitor are information contributed by the relevant firm.”

As I have stated previously, the areas of practice on the Law Society’s
Find a Solicitor Register and the SRA Solicitors Register do not provide
an exhaustive list of legal work that a firm is authorised to carry out.

This information is published in order to assist consumers in locating a
firm that specialises in the area of work they are looking for. These are
not the only areas of law that firms are authorised to practice in.

In my previous response I also stated that regarding Debt Collection work,
in order for a firm to provide this service they need to be regulated by
either the SRA or the FCA. They do not need any separate authorisation
from us other than meeting this requirement. You can read more about this
on our website:

[1]https://www.sra.org.uk/solicitors/guidan...

In my previous email I also explained that as a regulated law firm
employing solicitors, this firm is able to carry out both unreserved and
reserved legal activities. You can read more about reserved legal
activates and who can carry these out on the legal services board website:

[2]https://legalservicesboard.org.uk/enquir...

If you have concerns about a Law Firm you can report this to our
assessment team, you can read more about this process and how to make a

Dear SRA Information Compliance

Thank you for confirming that the SRA register was inaccurate (a second mistake) who is responsible for the accuracy of the details and completing your register, is this the SRA or your regulated solicitors. The SRA have also previously corrected the wrong company name given out by the SRA.

The Law Society does not authorise solicitors for any legal work and are not a solicitor paid membership regulator and the SRA have been asked to clarify exactly what legal work is authorised by the SRA and for which legal entity that you have regulated, both their company and their prior partnership firm.

J E Baring Ltd is regulated by the SRA since 14 January 2020 appears according to the SRA not to have carried out any legal work until 1 March 2021, please clarify and confirm if at any time they were authorised by the SRA to operate as a split entity up and until they merged their partnership firm on 1 March 2021 with their company.

Can you also confirm why it has taken in excess of 9 months for the SRA register (now reflected in the Law Society register to be updated and to warn consumers that the partnership firm J E Baring & Co is closed from 1 March 2021) and the reason why the solicitors website still refers to partners acting within a partnership when this partnership was incorporated/merged with their company on the 1 March 2021.

Are the solicitors and/or the SRA required to update accurate information within a certain time period to protect consumers and third parties and who rely on the accuracy of the registers, what actions have the SRA taken and against who for this delay, do you have a policy on transparency requiring mandatory accurate complete information to be provided to the public by both the SRA and your members (solicitors).

Which legal entity(s)are the SRA stating is regulated for Debt Collection work.

Which legal entity(s) are the SRA stating is regulated for Debt Recovery services work.

Which legal entity(s) are the SRA stating is regulated for Debt and bankruptcy - personal work

Please confirm the dates that authorisation was granted and/or changed for the individual partners within their former partnership J E Baring & Co and their company J E Baring Ld.

It would appear to a reasonable person that the SRA is reluctant for whatever reason to state exactly what legal work (services) these solicitors via their separate and different legal entities have been authorised to carry out. If these solicitors are authorised to practice in other areas of law please list them all and from which dates.

Yours sincerely,

Lin Ball

Is it coincidental that this FOIR was put in on 1 March 2021 and this solicitors partnership firm incorporated/ merged their partnership with their company the same day. Why would the SRA wait so long in excess of 9 months to update their SRA register.

Dear Solicitors Regulation Authority

The FCA have confirmed, who receive their information from the SRA, that J E BARING & CO (the partnership) records on the FCA were NOT updated until 31 December 2021, when this partnership had previously closed on 1 March 2021.

What sanctions if any do the SRA impose and upon who for the registers failing to be updated with the correct and transparent information that is a requirement to protect members of the public?

How are companies created by solicitors that never appear to have traded and who have only filed accounts for a dormant company, and dissolved on 29 Mar 2019 allowed to carry out Debt Recovery work, when neither the company or any of the solicitors are listed on The Law Society register for this area of legal practice and the company has never been SRA regulated?

J E BARING & CO LIMITED
https://www.scottishtrustdeed.co.uk/cred...

Are solicitors exempt from FCA (EPF) when carrying on the business in the legal practice area of debt recovery if neither they as solicitors or their company or partnership are regulated by the SRA for debt recovery work and none of the solicitors or their partnership or companies are listed on The Law Society in the legal area of practice for Debt Recovery.

And if none of JE Baring solicitors (either as partners of their partnership or as directors of their companies both current and dissolved) are listed as carrying out Debt and bankruptcy - personal, as a legal practice area, and are unregulated as a partnership or company to carrying out this work?

Is it illegal to claim to be able carry out any work as solicitors if they are not authorised and regulated by the SRA and listed on The Law Society register for a particular practice area?

If there is a hidden exemption for solicitors please provide it.

The current company J E BARING LTD is made up of the following on the Law Society website:

Bradley Keith Bloom areas of practice, Commercial litigation, Company and commercial, Employment, Insolvency and restructuring - business , Litigation- general

Allan James Hooper areas of practice, Commercial litigation, Company and commercial, Conveyancing- residential, Employment, Insolvency and restructuring- business, Litigation- general.

Jack Bending areas of practice, Conveyancing - residential, Landlord and tenant - residential

When were any of the above solicitors authorised and regulated by the SRA to carrying out the following legal practice areas when none are listed on the Law Society register as practicing in these areas.

1. Debt recovery
2. Debt and bankruptcy - personal
3. Please state if any were authorised as a partner of their partnership J E Baring & Co, and/or the following companies
4. J E Baring & Co Limited, and/or
5. J E Baring Ltd

Dear Solicitors Regulation Authority,

When will the SRA as an independent regulator responsible for regulating solicitors be providing the outstanding information requested on the 11 December 2021 and again on the 17 February 2022 ?

The SRA stated on the 17 February 2022 that you would be abiding by the FOIA under your Transparency Code within 20 working days, this FOIAR was placed on 1 March 2021, the exact same day the partners within the partnership J E Baring & Co closed.

Yours faithfully,

Lin Ball

Why would the SRA want to conceal what areas of legal work their paid membership solicitors (firms/companies) are authorised to carry out or how they are constituted.

Why would a firm of solicitors who closed their partnership on 1 March 2021 still refer to partners on their website.
