J E BARING LTD 12146662 regulated by SRA 14 January 2020

Can you confirm how many complaints Companies House has received concerning this company and former company J E BARING & CO LTD08376196 dissolved 29 March 2016 that use the trading name "J E Baring & Co" and the same name as the partnership firm.

Can you please clarify if this current company incorporated 8 August 2019 but not regulated by the SRA until 14 January 2020 can include their partnership details in their headed paperwork whilst signing in the trading name of the company as 'J E Baring & Co '.

How is it possible for a partnership firm to be signing in a company trading name, letters and court documentation etc when this company was either not in existence or not regulated by SRA on certain dates or carry out certain work.

The current company registered address is 1st Floor, 63-66 Hatton Garden, London, and their email address [email address] for this company appears on their website. (Notice the subtle change in spelling of the first line of their address changed from First Floor to 1st Floor.) which is the previous address of their former company and current address of their partnership firm.

Are the directors allowed to send out documentation on headed paper with J E Baring & Co solicitors with their partnership address 'First Floor' with their company email address and yet sign as a company trading name 'J E Baring & Co' with their company name 'J E Baring Ltd' trading as J E Baring & Co (Registered in England No.1214662 Authorised and Regulated by the Solicitors Regulation Authority No. 666652 Registered Office: FIRST FLOOR, (which is their registered partnership address not their registered company address) Directors: A Hooper, B Bloom and J Bending, at the bottom.

Are these solicitors allowed to mix and match their legal entities to conceal who has really been instructed by their client and in which capacity either as a director of a company or as a partner in a firm.

Advice is not required only information that you hold regarding companies and the behaviour of their directors.

Can please provide all the information and policy you hold that clarifies if a company (for instance J E Baring Ltd trading as J E Baring & Co ) acting through its directors could possibly send out correspondence, letters and court documents legally, if they contain inaccurate and misleading information and are signed in a trading name.

Are directors of a company entitled or not to send out documentation on headed paper with the wrong registered company office address and include a partnership address instead (similar but different).

Are directors of a company entitled or not to sign documentation in a trading business name rather than their company name when the former is not a legal entity and could be seen by a reasonable onlooker as misleading and deceitful if their intention is to conceal who the documentation is really from and in which legal capacity it has been sent.

You originally asked if complaints had been received in relation to J E

You have now responded, below, saying that ‘advice’ is not required? To
clarify our response of 16 March 2021 did not offer advice, it simply
answered your question that no complaints were held.

they are not  valid FOIA requests.

Thank you for confirming that Companies House has no interest in whether or not the companies that they register with Companies House are using a trading name instead of their correct legal name to identify which legal entity they are and could mislead the public (especially if this trading name is also the name of a partnership that may be trading concurrently).

If this is incorrect and you do hold policies and take actions to prevent any misleading and deceitful actions by companies you register, please provide clarification as to what action, if any, you do take.

We have considered your email below and after carefully considering the ICO guidance, we are of the view that the burden of answering your requests is excessive and/or have been previously complied with and are therefore refusing to answer your latest correspondence under sections 14(1) and 14(2) of the FOIA.

Under section 14(1) of the FOIA we are not obliged to comply if we consider the request is vexatious, and under 14(2) where we have previously complied with a request for information, we are not obliged to comply with a subsequent identical or substantially similar request.

Further, your correspondence is posted on the ‘Whatdotheyknow’ forum which is specifically for requests for information under the freedom of information legislation. We have explained on a number of occasions that several of your requests are not valid under the legislation but nevertheless we have assisted you with information and advice. We have also advised you of the appropriate route to raise concerns about companies with Companies House, which is via our enquiries team. It appears that you have not done this.

Finally, we should inform you that as we are relying on section 14 (1), we will not, in reliance on section 17(6), provide any further acknowledgements or refusal notices in response to any further requests.
