And confirm the name of the solicitors and whether they are required to have their own separate SRA numbers as well as a separate SRA number for their companies ?

(SRA) have ID numbers.

 

Our records show the SRA ID number for J E Baring & Co is 46559 which is
based at First Floor, 63-66 Hatton Garden, London, EC1N 8LE. I have found
no record of a J E Baring & Co Limited.

 

With regards to the publication of SRA ID numbers, firms are required to
publicise either the firm's registered name and number if it is an LLP or
company or, if the firm is a partnership or a recognised sole practice,
the name under which it is licensed/authorised by the SRA and the number

I am still some what perplexed as how one would know which firm they were instructing when similar names and addresses are used, and to who payment should be made , either to the partnership or the company ?

Are you saying that solicitors can set up unregulated limited companies thereby not SRA regulated ( does anybody else regulate these companies ?) and who are not be allowed to trade as solicitors under the non regulated company for example using the same address but in a different format for example ; C/O address as listed on companies house that is the same partnership address, minus the 'care of ' registered with the SRA below ?

Or can they be instructed under one format as a SRA partnership for instance and be paid as a limited company or vice versa ?

The client should always be aware of who they are dealing with. This is
often laid out in the client care letter, however if the client is in any
doubt then they should approach the firm directly for further information.

 

If a solicitor wishes to set up a limited company and register with
Companies House, we do not need to be aware of this unless the
organisation will be trading as a solicitors firm or owning part of a
solicitors firm. The regulator of the organisation would be entirely
dependent on the type of business.

Solicitors can own unregulated limited companies, provided they are not
trading through the company as solicitors and provided they are not
offering reserved legal activities. For further reference see Chapter 12

Not everyone will know the complex set-up available to solicitors, and would have no idea that there could be more than one company or set-up with similar names and addresses, who may or may not be regulated and listed with the SRA. Nor would they know if they were operating as they should be, especially as information as to disciplinary action might not be accessible and remain hidden at the discretion of the SRA; presumably leaving them to carrying on business as usual.

companies and leave them dormant. As detailed in our previous email If a
solicitor wishes to set up a limited company and register with  Companies
House, we do not need to be aware of this unless the  organisation will be
trading as a solicitors firm or owning part of a  solicitors firm. The
regulator of the organisation would be entirely  dependent on the type of

So basically are you saying that either the client or people being prosecuted by solicitors firms have to do multiple checks themselves and there is no duty on the solicitors who set up their firms to display full and accurate information.

Can you please answer how it it possible to know as either the client “who should always be aware of who they are dealing with and this is often laid out in the client care letter” but how would non clients being prosecuted know who they are dealing with.

Do the clients have a duty to confirm who has been instructed as a solicitor and how the firm is set-up if full details are not available on the solicitors websites etc and may differ from the solicitor letters sent out to non clients or clients.

What would stop them giving out completely different details in their letters.

People could be left in complete ignorance and at the mercy of solicitor firms who could well set up multiple firms in multiple ways with very similar names and similar addresses without displaying any company details or SRA number on their website.

For instance the address showing on the website is.

the public domain. If a person needs more information about a firm they

addition of ‘first floor’ and ‘England’ but no difference in the building

So basically are you saying that either the client or people being
prosecuted by solicitors firms have to do multiple checks themselves and
there is no duty on the solicitors who set up their firms to display full
and accurate information.

 

Can you please answer how it it possible to know as either the client “who
should always be aware of who they are dealing with and this is often laid
out in the client care letter” but how would non clients being prosecuted
know who they are dealing with.

 

Do the clients have a duty to confirm who has been instructed as a
solicitor and how the firm is set-up if full details are not available on
the solicitors websites etc and may differ from the solicitor letters sent
out to non clients or clients.

 

What would stop them  giving out  completely different details in their
letters.

 

People could be left in complete ignorance and at the mercy of solicitor
firms who could well set up multiple firms in multiple ways with very
similar names and similar addresses without displaying any company details
or SRA number on their website.

 

For instance the address showing on the website is.

Regarding your comment below about the three different addresses being the same ;

The differences were pointed out to the SRA, although similar they are not the same as listed on SRA website.

The SRA address is different to both the website address and the company address.

The solicitors website address does not contain the words First Floor ( SRA address) or C/O First Floor ( Company address).

'Regarding the three different addresses you refer to below, I can see the
addition of ‘first floor’ and ‘England’ but no difference in the building
number, street name, city or postcode.'

Therefore this company has registered two separate but similar addresses with the SRA and Companies House and with a different version on their website.

Can you please state under which of the above setups they are allowed to act as solicitors carrying on legal activities; what activities are allowed and what activities are forbidden by the SRA?

Does “Co” that is synonymous with company as listed on the SRA register not also mean company, does seem very confusing if not misleading ?

I can confirm that we previously authorised solicitors as insolvency
practitioners.  This has recently changed.  Now solicitors wishing to
carry out regulated insolvency activity would need to apply to another
suitable regulator for authorisation.  I attach a link to the closed

Thank you for your email of 29 April and 3 May, and I am sorry we did not
respond on Tuesday.

In terms of not providing information about complaints we have received
about the firm, that is our current policy position for reasons explained
by Ms Squire, however our policy is under review at this time. We
recognise the importance of transparency and have to consider carefully
what information would be most useful to members of the public in order to
have an accurate picture of the regulated firm. As I said we are working
through these issues at this time with a view to publishing more
information than we do currently.

With regard to your other question the firm is regulated by us and we do
therefore regulate the work it has advertised and the firm is required to
adhere to our code of conduct when practising. Since November 2015 we no
longer regulate solicitors who act as insolvency practitioners i.e. if an
individual wanted to be an official office holder in insolvency and a
trustee in bankcruptcy they would would need to be regulated by another
regulator. There will be certain legal work surrounding insolvency, such
as issuing bankcruptcy petitions, for which you do not need to be an
official office holder, this litigation would be permissable under our
rules and we would therefore regulate that solicitor and our rules of
conduct would apply.

Are you saying that solicitors firms do not have to list the correct address as shown on your website but only a variation of it ?

Please provide your policy on accurate details being required to be filed and shown by the SRA.

Can you please also clarify if the address shown on their website that matches the non-limited business company J E Baring & Co ( company number 3483212) with Mr Allan Hooper listed as Manager who is listed as a solicitor with SRA and minus Mr Bradley Bloom details showing in the links below , would this be a serious regulatory concern if they were being paid by various councils for work via another avenue rather than as a partnership that you regulate ?

misleading or inaccurate information about their location, and as advised
we will be passing this on to our colleagues.

I do not understand your question about payment and we are unable to
answer questions about how the firm may have received payments. If you
have evidence of wrongdoing on the part of a firm please do send that to
[1][email address] so that can be assessed and considered in accordance
with our procedures. We have done our best to answer your queries
generally but if you have information and evidence of wrong doing, I hope
you will understand that that will need to be considered by my colleagues
