Dear Department for Education,

I am the respondent in the upcoming High Court case IW Council v Jon Platt. I would like all information you hold in relation to this case including but not limited to any legal advice given to the Department, conversations and emails between the Isle of Wight Council / Hampshire County Council where this case is mentioned, notes or recordings of any meetings between the Dept for Education and any other public body including but not limited to the IW Council or Hampshire County Council. I would also like to know what the Department for Education considers to be 'REGULAR ATTENDANCE' for the purpose of s444 of the 1996 Act. (As you will be aware not defining REGULAR ATTENDANCE and subsequently pursuing criminal prosecutions could be considered a breach of Article 7 of the ECHR and the leading judgment in R v Rimmington). Thank you for your request for information, which was received on 17 March. You requested:

I am dealing with your request under the Freedom of Information Act 2000 (“the Act”).
The Department holds the information you have requested. However, I consider that the following exemptions apply to your request:

* Section 36 as the information’s release would be likely to inhibit the free and frank provision of advice, the free and frank exchange of views for the purposes of deliberation and might otherwise prejudice, or would be likely to otherwise prejudice the effective conduct of public affairs.

* Section 42 as that information in respect of which a claim to legal professional privilege could be maintained in legal proceedings is exempt information.

The Act obliges the Department to respond to requests promptly, and in any case no later than 20 working days after receiving your request. However, where one of the exemptions listed above is applicable, the Department must consider whether the public interest lies in disclosing or withholding the information. In these circumstances the Act allows the time for response to be longer than 20 working days.
In your case the Department estimates that it will take an additional 20 days to take a decision on where the balance of the public interest lies. It is anticipated that you will receive a full response by 6 May. If it appears that it will take longer than this to reach a conclusion, we will keep you informed.
There is also information, in scope of your request, which constitutes personal information relating to you, the release of which we are required to consider under the Data Protection Act. In order to ensure that we only supply personal data to someone who is entitled to see it, we need you to confirm your identity. As it is our policy to provide personal data in hard copy via Royal Mail, we also need you to confirm your home address.

For these purposes, please supply me with a copy of either a recent utility bill or your driver’s licence showing your name and current address.
If you have any queries about this letter, please contact me. Please remember to quote the reference number above in any future communications.
If you are unhappy with the way your request has been handled, you should make a complaint to the Department by writing to me within two calendar months of the date of this letter. Your complaint will be considered by an independent review panel, who were not involved in the original consideration of your request.
If you are not content with the outcome of your complaint to the Department, you may then contact the Information Commissioner’s Office.
