Hello,

I am writing to request an internal review of this frankly laughable response to my Freedom of Information request.

In general the handling of this request has show a serious disregard for the Senedd's responsibilities under the act with a number of unjustified delays that lead to a seriously overdue response is worrying. I was repeatedly told information was being sought, but if this delay was simply to allow the Presiding Officer to refuse information under Section 36 this appears to be an abuse of the FOI process to conceal information which involved misleading me about the reasons for the delays.

This combined with what appears to be a copy and paste justification of the use of Section 36 suggests that the request has not been treated with due diligence. The public interest test, though present, is superficial and does not consider the public interest implications of releasing this particular information rather it is a generic Section 36 Public Interest Test. I would therefore question whether a proper public interest test about the disclosure of these particular records has actually been carried out, as the response reads like a general cut-and-paste paragraph that is used when the Senedd has decided not to disclose information. The Information Comissioner's guidance on the P.I.T is clear in stating that "the authority must consider the balance of public interest in the
circumstances of the request" - here that has patently not happened as the records requested have particular importance to the transparency and accountability of the workings of a single, controversial incident in the Senedd where questions remain unanswered. The Comissioner also outlines in her guidance on the PIT that the specific information requested will weigh on the test...here the records requested would greatly add to the public understanding of how far "technical issues" did not did not prevent a MS from voting on a controversial motion and whether the Senedd did indeed offer the technical help and other options, as the Presiding Officer claimed happened. This transparency would either reinforce faith in Senedd proceedings and democracy that the MS did have appropriate time to vote and was offered support [therefore his constituent's voice was given a chance to be heard] or show that there is no evidence of IT support being offered to the MS and therefore inform public debate significantly in relation to the controversial vote. These are matters of extreme public interest as they relate to the democratic transparency and accountability of the Senedd both in general and in regard to a specific, controversial, vote and the omission of these facts in the PIT in favour of boilerplate language suggests that on review the PIT must be conducted much more thoroughly and with due regard to the specific information rather than being a generic exercise designed to reach the conclusion that the information must be witheld...which this appears to be.

Consideration to the Presiding Officer's own interests in relation to this information's disclosure must also be considered. Although I agree that Ms Jones is the qualified person in respect to Section 36 for the Senedd, I would contest whether she is in the position to provide a reasonable opinion as the requested information may leave her open to criticism and relates to her role in one of the most controversial votes in the Senedd's history. While sitting as the Presiding Officer Ms Jones closed the vote on the introduction of Covid Passes with Gareth Davies MS still trying to vote and the motion passed without his view being registered, by a single vote. If Mr Davies had voted the motion would have tied and therefore by convention have been defeated. In the chamber, Ms Jones claimed that a number of options had been presented to Mr Davies to vote and said in a subsequent statement to the BBC "I gave every opportunity for the member to be present - including providing ICT support - but the member was unable to be contacted." [https://www.bbc.co.uk/news/uk-wales-poli.... The disclosure of the requested documents has the potential to reveal if the fullest extent of ICT support was indeed offered to Mr Davies. It is obvious that documents relating to IT support and issues during the Covid Pass vote in October are of direct, personal interest to Ms Jones as they have the potential to either affirm or contradict her public statements on this. Section 36 requires a qualified person to form a reasonable opinion however having a personal interest of any kind in the information being requested raises serious questions over the reasonableness of said opinion as any human being would undoubtedly be swayed by the personal impact of potential disclosures more than an impartial observer. Therefore on review I would question whether Ms Jones's opinion is indeed reasonable in light of her own interest in the information requested and involvement in the centre of the controversial vote it relates to - any individual would be swayed by this and there are fair concerns to raise about the role of the Presiding Officer had in this vote and then subsequently arguing to keep information about the same controversial vote hidden from the public.

I am also concerned about the failure to properly articulate in the response how public affairs will be prejudiced by this disclosure. A potential example of a "safe space" is given but overall there is a general absence of any explanation of how the disclosure of routine, functional advice from the IT department about technical issues, months after the fact, amounts to an interference with the development of ideas, the debate of live issues or the freedom to reach decisions free from external interference. Safe space arguments diminish quickly once decisions are reached and subsequent votes on this particular issue in the Senedd suggests that it is relatively settled and therefore there is no protection needed for the discussion of how a past decision is reached. Although the IT department are vital to the Senedd's functioning it is not reasonable to compare disclosing their functional assistance with the safe spaces to make decisions or discuss ideas, as the exemption is outlined in ICO guidance, as it relates to the procedural nature of a single vote.

Furthermore in Hill v IC (EA/2019/0136) it was found that a Section 36 response was not a reasonable opinion when. a public body had been aware of an issue for a long time. Either the Senedd, which has been sitting remotely for more than a year, as long been aware of IT issues and therefore has already had a safe space to discuss their resolution and this s.36 opinion is grossly unreasonable, or this was a one-off event and there is no ongoing safe space to protect. The same ruling also found that an improper consideration of the public interest had been carried out, which for reasons already outlined, is clearly the case here as well.

I would underline that in this specific case that there is an overwhelming public interest in disclosure to protect faith in the Senedd's democracy and full representation of all members, that the Presiding Officer's personal interests in concealing this information makes her opinion an unreasonable one and that a serious error has been made in exempting IT support under provisions designed for policy or similar discussion and I urge you to disclose the information on review.
