“Can you please give me an indication of your current FY IT budget and
which IT systems you use to support and manage inspections? Also can you

Please clarify what you mean by “the average number of inspectors and
inspections”.
The FCA does not have a team of “inspectors” and none of the regulatory
activities we perform are categorised as “inspections”.
As part of our regular supervisory activities we may carry out “Firm
visits” for a variety of reasons. These may be regular scheduled events to
engage with our “Fixed Portfolio Firms” (see:

or ad hoc visits related to specific supervisory issues. For further

Similarly, in the context of our regulatory enforcement actions, we may
undertake formal investigations of firms and individuals, which may
involve on-site visits. For further details on the range of activities
carried out by our Enforcement Division, please refer to the following

We would need clarification on which one, if any, of the activities
carried out by our Supervision and/or Enforcement divisions you are
interested in.
Consequently, please also clarify what you mean by “the average number of
inspectors”. For example, would you like to know how many ‘investigators’
and/or ‘supervisors’ on average are employed by the FCA each year? Or are
you specifically interested to know the number of staff members who
perform specific tasks? If so, what are those tasks?
I will be unable to proceed with your request without clarification of the
information you wish to receive.
Please note that under guidance issued by the Ministry of Justice and the
Information Commissioner's Office entitled "Freedom of Information &
Environmental Information Regulations - Hints for practitioners handling
FOI/EIR requests", the following advice has been given with regard to the

Section 43 (Commercial Interests)
As this is a qualified exemption, the FCA is required to weigh the public
interest in maintaining the exemptions against the public interest in
disclosing any information.
By virtue of section 10(3), where public authorities have to consider the
balance of the public interest in relation to a request, they do not have
to comply with the request until such time as is reasonable in the
circumstances. The FCA has not yet reached a decision on the balance of
the public interest. Due to the need to consider, in all the

Thank you for your request under the Freedom of Information Act 2000 (‘the
Act’), dated 20 March 2017, for the following information:
“Can you please give me an indication of your current FY IT budget and
which IT systems you use to support and manage inspections? Also can you
please confirm the average number of inspectors and inspections per year?”
Since receiving your request, we have had subsequent exchanges which I
will summarise, below, to be helpful given it somewhat altered your
original request.
On 13 April 2017, we explained that the Financial Conduct Authority (FCA)
does not have a team of ‘inspectors’ and that none of the regulatory
activities we perform are categorised as ‘inspections’. We also explained
that, as part of our regular supervisory activities, we may carry out
‘firm visits’ for a variety of reasons including regular scheduled events
to engage with our ‘Fixed Portfolio Firms’, as well as ad-hoc visits
related to specific supervisory issues relating to our flexible portfolio
firms. Further, in the context of our regulatory enforcement actions, we
explained that we may undertake formal investigations of firms and
individuals involving ‘on-site visits’.
Following this, on 18 April 2017, you confirmed that you would like
information on any firm visits relating to our supervisory activities as
defined above, as well as information on any formal investigations of
firms and individuals, which may involve on-site visits. You also asked
“…how many ‘investigators’ and/or ‘supervisors’ on average are employed by
the FCA each year”.
On 17 May 2017, we explained that some of the information requested was
exempt under section 43 of the Act (commercial interests), and that more
time was needed for us to balance the public interest arguments for and
against disclosure.
Having completed this exercise, we have now considered your request in
full and our response is as follows:
1) The FCA’s IT budget for the current financial year
The FCA’s IT budget for the financial year 2017/18 is £86.5m.
2) The annual average number of firm visits carried out in relation to
a) our supervisory activities (inclusive of both our ‘Fixed Portfolio’ and
‘Flexible Portfolio’ firms), and b) formal investigations of firms and
individuals, which may involve ‘on-site visits
Before answering this part of your request, I would like to clarify that
the FCA is responsible for supervising over 56,000 firms and we supervise
the market using different approaches. Our three main approaches to firms
supervision, relating to both ‘Fixed portfolio’ and ‘Flexible portfolio’
firms, are:
• Pillar 1 – proactive supervision for the biggest firms.
• Pillar 2 – event-driven, reactive supervision of actual or emerging
risks according to our risk appetite.
• Pillar 3 – thematic work that focuses on risks and issues affecting
multiple firms or a sector as a whole.
More information on the FCA’s approach to market supervision can be found
[1]here.
In relation to 2a), I can confirm that we hold information relating to
meetings held with fixed portfolio firms as part of Pillar 1 and Pillar 2
supervision, which is detailed below. However we are unable to confirm the
exact number of firm visits held in relation to the supervision of
Flexible portfolio firms and in relation to all Pillar 3 supervisory
activities, for the reasons set out below.
Fixed portfolio firms (Pillar 1 and 2): Our data shows that 1,487 meetings
with fixed portfolio firms were recorded during the financial year
2016/17, where the meeting was not held on FCA premises and which could
therefore be construed as ‘firm-visits’. Please note because of the
transition to a new way of recording data on our systems, this figure
cannot be directly compared with the historic figures for the years prior
to 2016/17, when lower numbers of meetings would have been recorded. For
this reason, we have provided you with the actual number based on the
latest available data, which we consider more accurate, rather than the
historic average.
Flexible portfolio firms (Pillar 1 and 2): We do not hold a record of the
average number of firm visits relating to flexible portfolio firms. To
determine such figure would amount to creating new information as we would
need to engage in extensive research and analysis of the individual
records relating to each firm we supervise and we estimate this would
exceed the cost limit provided for in the Freedom of Information and Data
Protection (Appropriate Limit and Fees) Regulations 2004, therefore
Section 12 (Cost of compliance exceeds appropriate limit) of the Act
applies. For a detailed explanation as to why this exemption applies,
please refer to Annex A.
Pillar 3 initiatives: We cannot provide the figure relating to meetings
held as part of our Pillar 3 supervisory activities because, while some
firms may have been involved in significant Pillar 3 supervisory activity,
or activity with other areas of the FCA which might have required meetings
between the firm and the FCA, we estimate that to determine the number of
these meetings would exceed the cost limit provided for in the Freedom of
Information and Data Protection (Appropriate Limit and Fees) Regulations
2004, therefore Section 12 (Cost of compliance exceeds appropriate limit)
of the Act applies. For a detailed explanation as to why this exemption
applies, please refer to the Annex A.
In relation to 2b), based on records held for the last five calendar
years, the average number of formal Enforcement investigations of firms
and individuals (which may or may not have involved an on-site visit)
opened was 126.
3) The average number of a) ‘supervisors’ and b) ‘investigators’
employed by the FCA each year
In relation to 3a), the information relating to the average number of
staff employed by the FCA is contained in our published ‘Annual Report and
Accounts 2016/17’, which is available [2]here. The relevant information
can be seen on page 76 of the report and shows that the average number of
staff employed in Supervision during 2017 was 1,332. Please note we do not
hold recorded information on the precise number of staff who may be
directly involved in firm visits within the divisions and we are of the
view that to determine such figure would equate to creating new
information, as we would need to engage in extensive research and analysis
of the roles and responsibilities performed by each member of staff across
various teams. Under the act we have no obligations to create new
information to comply with a request.
In relation to 3b), the ‘Annual Report and Accounts 2016/17’ shows that
the average number of staff employed within the FCA’s Enforcement & Market
Oversight during 2017 was 670. However, our Enforcement divisions did
carry out further in depth analysis of the roles performed by their staff
and have been able to establish that the average numbers of individuals of
all grades and all types of contracts employed to work in Enforcement
investigation case teams over the last five financial years was
285.
4) IT systems you use to support and manage the activities specified in
question 2
The following IT systems are used to manage/schedule firm-visits carried
out as part of the FCA’s supervisory activity as well as on-site visits
carried out within formal Enforcement investigations:
• Financial Services Register, including Register Administration
• INTACT/Connect: the FCA’s online system and portal to collect firm
and consumer intelligence. Used to record and schedule firm visits
• TARDIS: the FCA’s internal firm database
• Livelink: a web-based collaboration and document management system
• Microsoft Outlook: email client and calendar organiser

· General right of access to information held by
public authorities
Under section 1(1)(a) of the Act, any person making a request for
information to a public authority is entitled to be informed in writing by
the public authority whether it holds information of the description
specified in the request. If the public authority holds information of the
type specified in the request, the person requesting the information is
entitled under section 1(1)(b) to have the information communicated to
them. The rights in section 1(1)(a) and (b) are, however, subject to a
number of exclusions and exemptions, including the following:
· Section 12 (Costs of compliance exceeds appropriate
limit)
The Act requires us to comply with a request, unless it would be too
expensive to do so, as estimated in accordance with the Freedom of
Information and Data Protection (Appropriate Limit and Fees) Regulations
2004 (“the Regulations”) made by the Ministry of Justice. The Regulations
provide that, for the FCA, the cost limit is £450, i.e. 18 hours at the
rate of £25 per person hour. The Regulations allow us to take into
account, when estimating the cost of complying with a request, time spent
determining whether we hold the information requested, locating and
retrieving it and extracting the information from the relevant
document(s).
Because of the way Pillar 3 activities are organised, we do not hold a
centralised record of meetings held with individual firms and to determine
the exact number of such meetings held during the relevant period we would
need to review manually the files relating to all Pillar 3 initiatives.
By way of example, since 1 April 2016 we have identified the records of 85
Pillar 3 projects which may contain information responsive to your
request.
As not all Pillar 3 projects necessarily involve meetings with individual
firms, we would need to go through each project with the relevant project
manager to determine if meetings were held and, more importantly, whether
such meetings were held within the FCA’s or the firms premises. Based on
an estimate of 15 to 30 minutes per project, it would take us between 21
and 42 hours to complete this exercise for this limited period only, and
it would far exceed the appropriate time limit if we were to consider the
broader timeframe of your request.
Likewise, to determine the exact number of Pillar 1 and Pillar 2 firm
visits carried out in relation to Flexible portfolio firms would require
us to examine the individual files relating to all such firms. As most of
the 56000 firms we supervise are classified as flexible portfolio firms
this would far exceed the 18 hour limit.
As our policy is not to divert our resources from our regulatory functions
in order to meet requests under the Act in excess of the cost limit, we
will not carry out an exercise to identify the information you have
requested.
We have considered if we can assist you by suggesting how you might narrow
the scope of your request to come within the cost limit. However, due to
the large volume of records that we would need to review to extract the
