Dear Isle of Wight Council,

Given the new arrangements for waste collection I wish to be
supplied with all recorded information the Council holds as to
whether re-cycling is compulsory or otherwise. Could you also
please inform me of any fines or sanctions applicable, including
details and rates, for non participation or for placing waste in
the wrong containers. (ie non recyclables in recyclable containers,
and vice-versa) along with an explanation of the legislation this
is based on.

Thank you for your information request dated 11^th of January 2012.

 

As required by the Freedom of Information Act 2000, the Isle of Wight
Council is required to respond to you as soon as possible and no later
than 20 working days after the receipt of your request.

 

We will endeavour to reply to your request as soon as possible, however,
in view of the amount of information requested and the high level of
enquiries within the waste department at present there may unfortunately
be a delay in your request.   We are sorry for any inconvenience that this
may cause.

 

Under the Act, there is a limit for responding to requests where they
exceed the Appropriate Fee Limit as set out in the Freedom of Information
and Data Protection (Appropriate Limit and Fees) Regulation 2004. The fee
limit is set down by the Lord Chancellor and is £450 which equates to a
maximum of 18 hours of search and retrieval time. 

 

Should your request fall into this category, we will notify you as soon as
possible, to discuss any options available to you.

I can advise that recycling is not compulsory to island residents although
is recommended. There are no fines applicable for a householder not
undertaking recycling or for placing waste in the wrong container; the
only sanction that would be applicable is that recycling waste would not
be collected where it is identified that it contains non-recyclable items.

 

Some of the information that we provide in response to Freedom of
Information Act requests may be subject to copyright protection. In most
cases the copyright will be owned by the Isle of Wight Council. The
copyright in other information may be owned by another person or
organization, as indicated on the information itself.
