Is your organisation prone to coverups against a former patient?

Waiting for an internal review by General Medical Council of their handling of this request.

Dear General Medical Council,

On 16th October 2015 two sets of NHS law firms provided a "Statement of Truth" that confirmed that EVERY doctor who I had approached for help REFUSED to consider for a moment that I might be telling the truth since 1995.

It was only after I managed to progress my case to a Judicial Review this year that the NHS lawyers finally acknowledged that my medical files contained false data and had been edited and interfered with.

So, I have the option of reporting 14 Doctors and GP's who are part of the mess that I find myself in; the "mess" being that I've had no GP after my former lawyer complained in 2014 that my medical files were still being withheld from me.

My situation is unreasonable; I am unable to move my life forward from aforementioned "Mess" and have no access to any unbiased Council Tax Services, NHS healthcare due to the false data being shared between them all and the refusal of the Council Tax Services to confirm what data shared between them all.

Questions;

A) Please clarify whether the Health & Safety of Doctor's patients is part of YOUR remit before I attempt to engage another Government Department into reviewing decades of clinical negligence and then coverup?

B) Please provide me the data that will assure me that I will not be wasting my time once I try to engage the GMC?

C) Please provide statistics that provide assurances that the GMC is not another tool used against members of the public and victims in order to coverup unresolved negligence by Doctors and GP's?

D) Since 2009, what is the ratio and outcomes of complaints against Doctors and GP's in i) Suffolk ii) Manchester? Please clarify whether your stats relate to months April to April or January to December?

Dear FOI,

I rang your organisation last week; since then I have been warned on here and in private NOT TO BOTHER WITH THE GENERAL MEDICAL COUNCIL.

This concerns me.

Therefore be in no doubt that after engaging in EVERY complaints procedure across 6 NHS sites and being subjected to mind games, torture and fraud by The Parliamentary Health Service Ombudsman between 2011 and 2016 then the utter farce of the CQC and Monitor; I need to be provided with data that will assure me that the General Medical Council will NOT be another waste of Public Money and my time?

As you will be aware the FOIA provides the right to request information
held by a public authority.  We don’t hold data that will provide answers
to your questions B and C.   As every case is different, we cannot make
any assurance as to whether a member of the public would be satisfied with
the outcome of a complaint they may make about a doctor.  

 

For question D,  we would be able to provide an analysis, but could you
please clarify

·         for ‘ratio and outcomes’ – do you mean a breakdown of outcomes?

·         are you interested in all doctors and/or only those on the GP
register?

 

The GMC’s publication [3]The State of Medical Education and Practice
(SOMEP) 2015 may be of interest.  [4] Chapter 2  summarises recent trends
in complaint outcomes.

Thank you for your reply on here.

I collasped with exhaustion in December 2006, except for the stitches and scar on my face, this is the only evidence I have because 13 Doctors were pro-active in editing my personal data from my records. It seems my medical history has been edited from Occupational Health notes in 2008 to The Director of The Parliamentary Health Service Ombudsman's report in December 2014.

Please note that the healthcare I sought since 2008 has never been provided to me yet.

Therefore, from you, I just require that data and statistics that will ensure me and allay my fears that I will not be wasting my (precious) time with the GMC.

Please note that the Public's confidence in a Public Service or servant is at the heart of the legislation Misconduct In Public Office.

As I explained on 13 October 2016, the GMC does not hold data that answers question B. We cannot comment on whether an individual would consider their time to be wasted if they made a complaint; this would be an opinion about a future situation, and does not fall within the scope of the FOIA. To assist you I provided links to information about our fitness to practise investigation processes, and a publication called SOMEP which includes data on trends in complaint outcomes. I am perplexed as to how to best respond to your feedback.

Q ONE:
*Are you seriously saying that the GMC has no methods of monitoring whether it is Fit for Purpose?

Since discovering that a GP wrote a false profile on me in 2009 that I had children in care (I got no kids); I have turned to EVERY organisation open to me for help; PALS, CQC, Monitor, NICE, DWP, ICE, ACAS, ICAS, POWhER, MIND, Voicability, Manchester Council, Suffolk Police, CPS, IPCC, The Local Government Ombudsman, The Parliamentary Health Service Ombudsman, and The Information Commission.

Now at the point that I follow the Ombudsman's advice and try to progress my case to a judicial review, the NHS lawyers secured an injunction on me in 2015 and 2016, I was (unbelievably) sent back to the same Doctor who I had lodged a complaint about in 2010.

This means that my engaging in EVERY complaints protocol since April 2009 has been an utter waste of my time. This is why I am reluctant to get involved with your staff when nobody is clear whether the GMC genuinely cares about public safety or not.

Q TWO:
*Therefore, you will hopefully appreciate WHY I seek evidence, statistics or given some morsel of data that would give me confidence that your organisation will not be another waste of my time?

I spent my 20's and 30's in Manchester. Everyone knew someone who's relative died in suspicious circumstances under Dr Harold Shipman. Has NOTHING been learnt from that miscarriage of justice against so many?

The terminology that I need to use in order to access the data that I have sought in private and on here is as follows;

I seek a copy of the audit of the outcomes for Fitness To Practise. I've explained (in detail) to your head of department the catalogue of reasons why I need to see the stats before I get in contact with the GMC.

Please pass my grateful thanks to your boss. He sounds a decent and genuine fellow and I'm making him a thank you care! I've not had a chance to say nice things about many Public Sector workers since discovering that I was being treated as a Child Welfare whistle-blower.

Following your conversation with my colleague, I understand that you’re
seeking information about audit of the GMC’s fitness to practise
process.   Again, we've looked at your request under the FOIA.

 

External oversight of the GMC as a regulator is conducted by the
Professional Standards Authority.  On their website you can read the
[1]latest performance review that covers the GMC at Chapter 12;  their
review of the fitness to practise investigation function is covered at
p77-84 of this document.  

 

Internally the GMC’s Quality Assurance team undertakes regular audits of
all stages of the fitness to practise process.  This work is reported to
the GMC’s Performance and Resources Board; our Quality Assurance programme
for 2016 is published in the [2]Board minutes of 17.11.2015, and findings
will be produced in 2017.

 

GMC’s fitness to practise rules include a procedure called ‘Rule 12’
Review.  If a complainant is dissatisfied with our decision about a
doctor’s conduct or clinical practice, they can ask for the case to be
reviewed.  There is an overview of our complaints processes, including
Rule 12, on our website [3]here.   Rule 12 is a robust process that
scrutinises the decision making and evidence, and it results in a
re-opening of an investigation in around 5% of the cases where a request
is made under Rule 12.

Firstly, it is apparent in private emails and on here that GMC staff have not had appropriate training.

A) You will be in no doubt from this FOI, that I am no longer able to manage the history of coverup that has been progressed against me.

If you best read my account or had any "empathy", you would have provided the data I sought on here and not direct me to other websites that further hide the data I sought from the GMC.

Is this not an appalling stat when one considers how challenging it is to progress a complaint against a rogue member of the NHS.

QUESTION; In respect of the Data Protection Action's 2nd Principle; Do you genuinely stand by your comment that 5% is "robust" when one considers how determined and aggrieved victims must have felt to keep pursuing a complaint against a poorly trained workforce that seems to lack empathy and ethics?

As part of my complaint please provide an explanation in respect of the following concerns;

1) Please clarify what you mean by the word "robust"?
"Rule 12 is a robust process that scrutinises the decision making and evidence, and it results in a

2) An individual has to be determined and tenacious to re-approach the GMC to review a decision, especially if the decision is upsetting and the victim has been unable to access basic healthcare treatment due to the negligence and coverup by Doctors; therefore, please clarify how the failure to best progress and resolve 95% of complaints against the GMC is "robust"?

Your organisation asked for clarity for my Question D;

I hope the following explanation assists the GMC;

The victims of a Doctor's malfeasance are blocked from resolving the errors against them. The victim then approaches the GMC and their complaint and evidence against the Doctor who refused to engage in any Mediation and Resolution Meetings.

The Victim then approaches the GMC after becoming the victim of perjury. Due to their medical records having been tampered with and edited, the victim is unable to find a lawyer or any legal representation.

The GMC refuses to investigate the lies and coverup that led to perjury against the victim.

This would not be an issue except that if the GMC is refusing to keep an audit of which Doctors are being reported then I cannot help but to ask;

1) WHAT IS THE POINT OF THE GMC if the Health and Safety of people when they are are at their most vulnerable is not your priority? (As a supporter of the NHS, I am genuinely perplexed.)

Additional question in response to your request for clarity;

2) Who, in the UK is monitoring those rogue doctors in order that the UK Public's Health and Safety is assured?
