Is the agenda of the PHSO and NHS complaints system one of cover up rather than resolution?

Response to this request is long overdue. By law, under all circumstances, NHS England should have responded by now (details). You can complain by requesting an internal review.

Dear NHS England,

I refer you to the this FOI request to The Parliamentary Health Service Ombudsman.

https://www.whatdotheyknow.com/request/d...

Since September 2012;

1. Please confirm the times that Dame Julie Mellor and other PHSO staff have contacted the board of NHS England to review/ discuss/ resolve or confirm the amount of NHS complaints being progressed against the NHS due to requested data being edited from Subject Access Reports and medical assessments?

2. How many warnings has The Information Commission given to NHS in relation to unresolved public concerns about the amount of data edited from NHS records which would spot light clinical errors, neglect and maladministration.

3. If you do not have access to the data requested in points 1 & 2 then please could NHS England direct me to that data which confirms that the issue of edited data in order to cover up maladministration and negligence is NOT endemic in the NHS since September 2012?

Please note that my FOI request has been sponsored and please do not hesitate to confirm and progress any necessary costs in order to process this data under UK law.

Your failure to BEST respond to the 3FOI requests may possibly lead to civil action as outlined in the pre-court protocols.

Yours faithfully,

Fiona Watts

Excellent FOI request Fiona...thank you for asking!

Maybe Dr Mike Durkin (Patient Safety Director for NHS England) can help. Seems he is responsible for Independent Patient Safety Complaints Service (IPSCS) too. Believe planning to come on stream in April 2016 & CQC National Patient Safety Adviser James Titcombe on panel. Dr Durkin is on Twitter!

Dear FOI England (NHS ENGLAND),

In respect of one of the principles of the Data Protection Act; please could all future replies be provided with the name of the NHS employee responding to my FOI request.

Yours sincerely,

Fiona Watts

As ever Dee - thank you for the tip off.

What is the track record of Dr Mike Durkin (Patient Safety Director for NHS England) IS HE GENUINE OR IS HE ANOTHER TIME WASTING TWIT who makes a job out of the misery that a corrupt NHS complaints system subjects victims to?

Until Mr Titcombe replies to one of Della Reynold's communication's I doubt he'll reply to any of my queries. He'll be trying to move his life forward now won't he?

Dear Ms Watts,

Re: Your Freedom of Information (FOI) request
Our ref:- FOI-008143

Thank you for your communication below dated 24 August 2015.

NHS England has an established process for responding to FOI requests which does not include names of officers drafting responses on behalf of the organisation. This is common practice for staff in junior, non-decision making nor public facing roles of NHS England.

Please be assured your request is being handled by a central team of whom can be communicated with regarding your request using the contact details below and as given in the acknowledgement. However, for formal replies from the organisation their name (for the reasons provided above) will not be provided. In the alternative, applicants are given the team and department details in order to continue any relevant communication with the organisation regarding their request or future requests.

I hope this information is helpful to you.

Dear Ms Watts,

Our reference: Request for Clarification (FOI: 008143)

Thank you for your Freedom of Information (FOI) request dated  2015.

NHS England may hold information relevant to your request.  However, we
are unable to begin processing your request without further clarification.

Under Section 1(3) of the FOI Act, an authority is not obliged to comply
with an FOI request when it reasonably requires further information in
order to identify and locate the information requested. I would be
grateful if you would clarify the following:

·         Exactly what is meant by “data edited” in question two of your
request.

It may help if I explain that ‘the NHS’ in England is not the same as ‘NHS
England’. The NHS in England is not a single organisation, but is made up
of a range of organisations including Hospitals, Clinical Commissioning
Groups (CCGs), Ambulance Trusts and other organisations. As such, any
recorded information which NHS England may be able to provide in response
to an FOI request will generally relate to the services commissioned by
NHS England. Further information on commissioned services and the types of
information NHS England holds can be found on our [2]website and
[3]publication scheme.

Please note that with regard to question 3, NHS England does not hold this
information. NHS England does not have to answer your question if this
would mean creating new information or giving an opinion or judgment that
is not already recorded. If a public authority does not hold recorded
information relating to your question, they will advise you that they do
not hold the information. In this instance, it would not be possible to
provide recorded information on this subject as this would be proving a
negative.

Please be assured we are keen to assist with your request. However, I
cannot guarantee that Section 12 or any other exemptions under the FOI act
will not apply to any further information requested.

Please send your clarified request to [4][NHS England request email] quoting
your reference number as it appears in the subject bar.

Dearest Dee Speers;

Apologies for missing your annotation back in August. I have been off-radar due to Suffolk Police and St Edmundsbury Borough Council making my life as difficult & unpleasant as their legal team and Joy Bowes can.

Firstly, THANK YOU for your support. Our situation is lonely as our supporters (understandably) get compassion fatigue.

As always, I will pursue your advise & action your links.

Best wishes and kindest regards,
Fiona

Dear FOI England (NHS ENGLAND),

I mean "data" as in ALL personal data relating to the patient.

'erh? .... what data did you think I would be referencing under UK data laws?!

Hi Fiona,
This is my first annotation for many months as the ' establishment system ' made me increasingly ill.
A careful look at my FOI requests will explain !
I refer to your annotation with the lovely Dee Spears on 28 08 15, re Patient Safety Director for NHS England .
Consider this - would he REALLY be in this post if he was going to respond to our many concerns fully, honestly and in good faith ? Please note - this is a question !

I think we will continue to see on WDTK , and many will experience themselves , that the entire public sector complaints process KNOWINGLY AND WITH INTENT DELIBERATELY subjects complainant victims to misery, abuse and avoidable harm via a system that is carefully managed to ensure the truth is covered up at all cost, complainants are bullied and denied their ' Rights ' and you will NEVER get a straight answer - do you agree ?

I fear once the Human Rights Act is taken away from us by those in power, things will continue to get worse on this downward spiral.

Dear Mr King.

YOU ARE SO RIGHT!

I am sorry to hear that you too have been worn down by a the farcical complaints procedures that PROTECT those public sector departments that never seem to be challenged for their maladministration.

Kindest regards,

Fiona

Dear FOI England (NHS ENGLAND),

What further clarification do you need here?

I wrote the following;
Dear NHS England,

I refer you to the this FOI request to The Parliamentary Health
Service Ombudsman.

https://www.whatdotheyknow.com/request/d...

Since September 2012;

1. Please confirm the times that Dame Julie Mellor and other PHSO
staff have contacted the board of NHS England to review/ discuss/
resolve or confirm the amount of NHS complaints being progressed
against the NHS due to requested data being edited from Subject
Access Reports and medical assessments?

CLARITY;
Either Dame Julie Mellor and her team have kept a best review of the issues that concerns the majority of NHS complaints or she is not. Which is it?

I am not a part of the PHSO but a quick scan through the majority of complaints against the PHSO seem to be about the failure of the PHSO to best review and challenge those NHS departments who are allowed to withhold the evidence that would demonstrate their maladministration against service users.

Yours sincerely,

Fiona Watts

Dear Ms Watts,

Re:      Freedom of Information request (Our Ref: FOI-009094)

To which we requested the following clarification on 7 September 2015:-

“Exactly what is meant by “data edited” in question two of your  request.”

You responded to this on 23 September 2015 with the following:-

laws?!”

NHS England responded to this email on 20 October 2015 with the
following:-

“Exactly what you mean by “edited”. For example, do you mean data removed,
added, amended or something else.”
