Irresponsible advice from lgo in relation to mental health

Waiting for an internal review by Office for Legal Complaints of their handling of this request.

Dear Office for Legal Complaints,

I write now under foi for confirmation that if a personal complains to the local ombudsman he is not told their are other avenues to complain ie court

Obviousley it is intimadating to face a financially well off company/council whilst under acute mental health care and i would like confirmation in this case if the person mentions mental health or care that this will not be a answer given?

The common view right now is the lgo acts as a way for councils to subdue and force those with disability into a course of action that is either financially not viable or would put a even bigger strain on the person leading to potential long term problems
Can you confirm this is not the law/rule regarding vulnerable people or people without obvious funds

It is important the lgo does not become a way to defend the councils against redress by advice that is no way possible given the circumstances of the complaint .

Freedom of Information Act (FOIA) - Request for information

Further to your request for information concerning confirmation that if a person complains to the local ombudsman he is not told that there are other avenues to complain.

Firstly, I would like to apologise for the delay in responding to your request.

I am unable to provide you with a confirmation as the Legal Ombudsman only deals with complaints about legal service providers such as a solicitor or a barrister. If a complaint has been made to us and it is against a legal service provider, we can consider the issues raised. When we have confirmed that we can look at the complaint, the Legal Ombudsman has the necessary procedures in place to deal with complaints from vulnerable complainants. We do this by allocating a dedicated vulnerable customer champion to deal with complainants on a one to one basis. We will help the complainant to draft a complaint against the service provider.

When a complaint has been brought to the Legal Ombudsman and it is not about a legal service provider, we are unable to deal with the complaint. We will however signpost you to a suitable organisation so that you can get the help needed. As the Legal Ombudsman, we will not be able to act as the advocate for you nor do we provide legal advice. Should you require assistance in complaining to another organisation you may wish to contact your local Citizen Advice Bureau, who may be able to assist you in drafting a complaint.

I hope the information I have provided will be helpful in answering your request.

i believe you have stated many times under foia that you would not recommend that a vulnerable person must go to court given the chances of success against much better supported councils
Please confirm this is not true and you still recommend those under care go to court even if it is not possible to do so
